Por FactBox Admin

The High Court of Justice of Navarre has admitted an administrative appeal against Foral Decree 30/2026, of 27 May, regulating the structure and operation of the Clinical Radiology Area. The summons to interested parties is published in Official Gazette of Navarre number 161, of 17 August 2026, with a period of nine days to appear in the proceedings.

The notice corresponds to ordinary procedure 313/2026, processed in the Administrative Litigation Chamber of the High Court of Justice of Navarre. By official communication of 28 July 2026, the court requested the referral of the administrative file and the service of summons to interested parties, in accordance with articles 48 and 49 of Law 29/1998, of 13 July, regulating the Administrative Jurisdiction. The communication appears in the general provisions section of the gazette, on page 29979, with reference F2610585.

A decree that reorganises Navarrese radiology

Foral Decree 30/2026, of 27 May, approved by the Chartered Community of Navarre, establishes the structure and operation of the Clinical Radiology Area. It is a healthcare organisation regulation affecting one of the essential diagnostic imaging services in Navarrese public health, approved less than three months ago and now subject to judicial review. The admitted appeal therefore challenges a recent provision of the regional government in an area with a direct impact on healthcare provision.

How to appear in the proceedings

In accordance with article 49.1 of Law 29/1998, publication in the official gazette serves as notification to all persons interested in the appeal. Those wishing to appear must do so before the Administrative Litigation Chamber of the High Court of Justice of Navarre, within the established period.

  • Period for appearing: nine days from publication of the notice, on 17 August 2026.
  • Body before which to appear: Administrative Litigation Chamber of the High Court of Justice of Navarre.
  • Procedure: ordinary 313/2026.
  • Signature of the notice: Beatriz Aceña Laparra, head of the Legal Regime Section, in Pamplona, on 30 July 2026.

A dispute with an impact on healthcare provision

The appeal falls within the administrative litigation jurisdiction, the judicial avenue provided for reviewing the legality of provisions issued by public administrations. The judgment handed down by the High Court of Justice of Navarre may uphold the structure of the Clinical Radiology Area or annul it, with consequences for healthcare planning and for the affected professionals. The proceedings are in their initial phase: the court has requested the case file and is now issuing the summons, a step prior to the processing of the appeal.

The publication of the summons makes the Official Gazette of Navarre the official channel for notifying a dispute affecting the healthcare organization of the Foral Community. The outcome of proceedings 313/2026 will determine whether the structure of the Clinical Radiology Area is maintained or must be modified, a matter of direct interest to patients, professionals, and managers of the Navarrese public health system.
