The TSJEx recognizes ULBASA's right to an agricultural aid denied by the Junta

The General Directorate of Community Agricultural Policy of the Regional Government of Extremadura has ordered the execution of final judgment 279/2026 of the High Court of Justice of Extremadura (TSJEx), which upholds the contentious-administrative appeal filed by ULBASA, SA and recognizes its right to receive an agricultural aid that had been denied. The resolution, signed on August 11, 2026, is published in the Official Gazette of Extremadura (DOE) number 159, dated August 18, 2026, with reference 2026062153.

The ruling, issued by the Contentious-Administrative Chamber of the TSJEx on May 5, 2026, annuls the administrative resolutions that dismissed the company’s application and orders the Extremaduran Administration to pay legal costs up to a maximum of 2,000 euros for all concepts, plus the corresponding VAT.

The litigation and its origin

Ordinary procedure 290/2025 began when ULBASA, SA (NIF A06065734) appealed the resolution of the Ministry of Agriculture, Livestock and Sustainable Development dated March 21, 2025, which dismissed the administrative appeal filed against the resolution of the Director General of Community Agricultural Policy dated February 12, 2025. The latter denied the aid requested by the company under Decree 87/2024, of June 30, in file AG-24-080.

The execution is based on Article 9.1 of Decree 59/1991, of July 23, which regulates the administrative processing of the execution of judicial resolutions and obliges the head of the competent body to issue the compliance resolution.

The court’s ruling

The judgment, which is final, fully upholds the company’s appeal and recognizes its right to be paid the aid in question. The literal ruling states:

  • Upholding of the contentious-administrative appeal of ULBASA, SA.
  • Annulment of the resolutions of February 12 and March 21, 2025.
  • Recognition of the right to receive the requested aid.
  • Order for the defendant Administration to pay costs up to 2,000 euros plus VAT.

Execution and signature

The execution resolution, issued in Mérida on August 11, 2026, orders the ruling to be carried out in full and due effect. The document is signed by the Director General of Community Agricultural Policy, Miguel Antonio Gutiérrez Creus.

The publication in the DOE provides official publicity to the execution of the judgment and fulfills the judicial mandate against the Extremaduran Administration.
