The TSJCV annuls part of Sagunt's logistics plan and protects agricultural land

The High Court of Justice of the Valencian Community (TSJCV) has partially annulled the Special Plan for the Sagunt Logistics Area by protecting 681,394.46 m² of agricultural land in the L’Arrif area. The ruling, contained in Judgment number 680/2025, dated December 22, is published by edict in the Official Gazette of the Generalitat Valenciana (DOGV) number 10434, dated August 21, 2026, in section IV of the Administration of Justice.

The judgment, issued by the First Section of the Contentious-Administrative Chamber of the TSJCV in ordinary proceeding number 176/2023, partially upholds the appeal filed by Francisco Martínez Benlloch and Vicente Sanchis Ruixo. The edict, signed by the Administration of Justice lawyer Gloria Herráez Martín in Valencia on July 30, 2026, publishes the operative part of the ruling.

The object of the litigation

The appeal was directed against the Resolution of December 2, 2022, by the Minister of Territorial Policy, Public Works, and Mobility of the Generalitat Valenciana, issued in file 2918341, which definitively approved the Special Plan for the Sagunt Logistics Area. Said approval was published in the Official Gazette of the Province of Valencia number 241, dated December 19, 2022.

The special plan classified an area of 681,394.46 m² in the L’Arrif zone as non-developable land of special agricultural protection (ZRP-AG), a reclassification that the appellants challenged.

The ruling and its effects

The judgment declares the partial nullity of the resolution and the special plan regarding that classification, and establishes:

  • The nullity of the classification as non-developable land of special agricultural protection (ZRP-AG) for the 681,394.46 m² of L’Arrif.
  • The obligation of the Generalitat Valenciana to maintain that land in its previous classification and designation as common non-developable land.
  • The non-imposition of legal costs.

Relevance of the pronouncement

The ruling conditions the largest logistics project in the Valencian Community by reducing the surface area that the special plan allocated for logistics uses in favor of the protection of agricultural land. The decision affects the owners of the lands in L’Arrif and forces the regional administration to rethink the urban development of the area, maintaining the previous classification of common non-developable land.
