El TSJC revisa la estabilización de Técnicos Especialistas en Laboratorio de Canarias

The Administrative Litigation Chamber of the High Court of Justice of the Canary Islands will review the final results of the merit-based competition for the stabilization of Laboratory Specialist Technicians of the Canarian Health Service. The General Directorate of Human Resources of the autonomous body has forwarded the administrative file of ordinary procedure no. 83/2026 to the First Section of the Chamber, based in Las Palmas, and summons interested parties to appear. The agreement is published in the Official Gazette of the Canary Islands no. 220, of November 4, 2026, section V (Other announcements), p. 39842, with the official reference boc-a-2026-220-3788.

The decision is adopted by means of the Resolution of October 22, 2026, of the General Directorate of Human Resources, issued in view of the official letter from the First Section of the Administrative Litigation Chamber dated September 11, 2026, which was received by the management center on September 17. The appeal is filed by Ms. Inés Abelleira Aguiar against the resolution of the Coordinating Tribunal that approved the final results of the competition phase of the exceptional selection process for the stabilization of long-term temporary employment (merit-based competition) of statutory personnel, in the category of Laboratory Specialist Technician, Health Group C/C1.

The invoked legal framework is that of articles 48 and 49 of Law 29/1998, of July 13, regulating the Administrative Litigation Jurisdiction, which obliges the Administration to forward the file to the judicial body and to summon those who have a direct interest in the matter. The announcement bears the signature of the Director General of Human Resources, José Ángel González Díaz, and is dated in Las Palmas de Gran Canaria on October 22, 2026.

Forwarding of the file and summons

The published text contains two specific mandates, both in the body of the resolution:

  • To order the forwarding to the First Section of the Administrative Litigation Chamber of the High Court of Justice of the Canary Islands, based in Las Palmas, of the administrative file of ordinary procedure no. 83/2026.

  • To summon interested parties so that they may appear and present themselves in said procedure “in legal form” and within a period of nine (9) days from the date of publication of the announcement in the Official Gazette of the Canary Islands.

The announcement contains no pronouncement regarding the suspension of the contested act nor regarding the execution of the competition results: it is limited to ordering the forwarding of the file and opening the period for appearance. Interested parties therefore have nine days from November 4, 2026, to appear before the Chamber if they wish to defend their positions in a litigation that affects the competition phase of the category.

2022 Call and April 2026 Appointments

The selection process giving rise to the appeal was announced by the Resolution of December 23, 2022, of the General Directorate of Human Resources of the Canary Islands Health Service (Official Gazette of the Canary Islands no. 255, of December 29, 2022), within the exceptional process for the stabilization of long-term temporary employment.

Following that call, the Resolution of April 10, 2026, of the Director of the Canary Islands Health Service was issued, through which appointments were made as permanent statutory personnel in vacant basic positions in the category of Laboratory Specialist Technician, Health Group C/C1, published in the Official Gazette of the Canary Islands no. 76, of April 21, 2026. In other words, the positions in this category have already been awarded and the appointments published, which demonstrates the practical scope of the lawsuit.

This is not the first litigation affecting this category. In the same stabilization process, the Resolution of August 14, 2026, of the General Directorate of Human Resources ordered the referral of the file for abbreviated procedure no. 416/2026, filed by Ms. Nayra Hernández Gutiérrez, to the Contentious-Administrative Section of the Court of First Instance of Las Palmas de Gran Canaria, Court no. 1, according to the announcement published in the Official Gazette of the Canary Islands no. 180, of September 8, 2026.

The difference in the body is relevant: that matter was processed via the abbreviated procedure before the Court of First Instance, while ordinary procedure no. 83/2026 has fallen directly under the Contentious-Administrative Chamber of the Canary Islands high court. Furthermore, the appeal by Ms. Inés Abelleira Aguiar was directed against the final results of the merit competition phase, not only against the subsequent appointments.

The publication of this announcement is important for all who participated in the merit competition for Laboratory Specialist Technicians and those already appointed to the category: any person with a direct interest has a period of nine days, starting from November 4, 2026, to appear in ordinary procedure no. 83/2026 before the First Section of the Chamber based in Las Palmas. The judicial outcome could reopen the discussion regarding the order of the final results of the merit competition phase of a stabilization process that has already culminated with the awarding of vacant basic positions.
