Por FactBox Admin

The Contentious-Administrative Chamber of the High Court of Justice of Cantabria has upheld appeal 146/2025 and has nullified the selection criteria for an Administrative position at the City Council of Santa Cruz de Bezana. The Official Gazette of Cantabria publishes on Wednesday, October 14, 2026, in issue number 197 on page 52712, the decree of the Acting Mayor issued in compliance with judgment 181/2026, dated April 30, 2026, which orders the reversal of proceedings and annuls the two contested municipal resolutions.
The judicial ruling and its scope
Judgment 181/2026, dated April 30, 2026, upholds appeal 146/2025 filed by Ms. Laura Julia de Vicente Rovira against judgment 134/2025, issued on July 23, 2025, by the Contentious-Administrative Court No. 3 of Santander, which had dismissed her initial appeal.
The ruling revokes that lower court judgment and annuls the two appealed municipal resolutions, rendering them void. The associated municipal file is 3463/2024-I.
The annulled resolutions and the reversal of proceedings
The resolutions that are rendered void are as follows:
- The resolution of the City Council of Santa Cruz de Bezana dated December 9, 2024, which partially upheld the appeal filed against the selection criteria for an Administrative position in Economic Services.
- The municipal resolution of January 16, 2025, by which the new criteria were approved for the selection, via a competitive examination system (concurso-oposición), open entry, of an Administrative position, General Administration scale, Group C, Subgroup C1 of the Economic Services area, and employment pool.
These criteria of January 16, 2025, had been approved as a correction and substitution of those published in BOC no. 182, dated September 19, 2024. The annulment is agreed upon as a reversal of proceedings, with effects dating back to the criteria approved on September 12, 2024, and published on January 23, 2025, in BOC no. 15.
Consequently, the call for applications structured under the competitive examination system, open entry, for the Administrative position, General Administration scale, Group C, Subgroup C1 of the Economic Services area, as well as the employment pool linked to that selection process, is rendered void.
Effects for applicants and notification
The decree of the Acting Mayor serves as notification to all interested parties, in accordance with the provisions of Article 45 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. The agreement was signed in Santa Cruz de Bezana on October 5, 2026, by the Acting Mayor, Manuela Bolado Alcalde.
The central elements of the ruling are:
- Judicial body: Contentious-Administrative Chamber of the High Court of Justice of Cantabria.
- Appeal granted: appeal 146/2025.
- Appeal judgment: 181/2026, dated April 30, 2026.
- Revoked judgment: 134/2025, dated July 23, 2025, from the Contentious-Administrative Court No. 3 of Santander.
- Affected position: one Administrative position, General Administration scale, Group C, Subgroup C1, Economic Services area.
- Effect: annulment of the resolutions of December 9, 2024, and January 16, 2025, with the reversal of proceedings.
Relevance
The publication leaves the municipal selection process without legal coverage as it was planned and obliges the City Council of Santa Cruz de Bezana to reverse the proceedings to the moment prior to the annulled rules. The ruling directly affects those who applied for the position and the resulting employment pool, and opens the way for a new processing of the rules in accordance with the judicial criteria. The dissemination of the decree in the Official Gazette of Cantabria fulfills the function of general notification required by law, such that the interested parties are formally informed of the annulment and its consequences on the procedure.
