El Tribunal de Melilla emplaza a los interesados en las ayudas turísticas

The Court of First Instance, Contentious-Administrative Section, Plaza nº 2 of Melilla has summoned all parties who may be interested in Abbreviated Procedure 100/2026, a contentious-administrative appeal against the call for grants for investment projects in hotel establishments, catering, and commercial premises linked to the city’s tourism activity. The announcement is published in the Official Gazette of the Autonomous City of Melilla nº 6422, dated October 13, 2026, with reference BOME-A-2026-1143, and grants a period of nine days to appear. The oral hearing is scheduled for January 13, 2027, at 11:00 AM.

The procedure was initiated at the request of Nuria Espigares Gutiérrez and concerns the call for investment projects in hotel establishments, catering, and commercial premises linked to the tourism activity of the City of Melilla for the year 2026. The summons is carried out in accordance with Article 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, in relation to Articles 40 to 43 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

The announcement is signed by Gema Viñas del Castillo, Technical Secretary of Economy, Trade, Technological Innovation, and Tourism, in Melilla on October 8, 2026, and is inserted in the section of the Ministry of Economy, Trade, Technological Innovation, Tourism, and Development of the gazette.

Deadlines and form of appearance

The agreement notified through the gazette establishes the following conditions for those who consider themselves affected:

  • Appearance deadline: nine days to appear as defendants before the court, in defense of their own interests.
  • Date and time of the hearing: January 13, 2027, at 11:00 AM.
  • Judicial body: Court of First Instance, Contentious-Administrative Section, Plaza nº 2 of Melilla.
  • Legal channel: Article 49 of Law 29/1998, with notification to all who appear as interested parties through publication in the Official Gazette of the Autonomous City of Melilla.

The publication in the gazette replaces individual notification, such that the period begins to be counted from the appearance of the announcement in issue 6422, dated October 13, 2026.

The appealed call and its management

The appeal is directed against the call for grants for investment projects in hotel establishments, catering, and commercial premises linked to the tourism activity of Melilla for the 2026 financial year. This aid scheme is processed under a competitive bidding system, and its management corresponds to the instrumental company Proyecto Melilla, S.A.U., dependent on the Ministry of Economy, Trade, Technological Innovation, Tourism and Development, according to the model set out in the calls published in the same issue of the bulletin.

In that same issue, the ministry publishes other extraordinary calls for business aid:

  • Order No. 2377, of October 5, 2026, for aid to investment projects in the City of Melilla (investment aid, year 2026).
  • Order No. 2424, of October 7, 2026, for aid for investment projects in commercial and service premises.
  • Order No. 2441, of October 9, 2026, for aid for the creation, expansion, and diversification of SMEs, especially youth-led ones.

These lines are financed by the ERDF Program for Melilla 2021-2027 and are resolved through competitive bidding, with a resolution that ends the administrative route and is appealable before the contentious-administrative jurisdictional order.

Scope for applicants and beneficiaries

The summons affects all applicants and potential beneficiaries of the challenged call, who may be concerned by the outcome of the procedure without having been party to its initiation. Appearing within the deadline allows them to defend their interests and allege whatever they deem appropriate before the hearing.

The announcement is limited to communicating the summons and the date of the hearing; it does not anticipate the sense of the judicial resolution nor does it by itself suspend the processing of the call.

The publication of this summons in the Official Gazette of the Autonomous City of Melilla turns the litigation into a matter of mandatory monitoring for the city’s hotel and catering sector, which sees these grants as a relevant means of financing its investments. Any entrepreneur with a legitimate interest in the call must decide in barely nine days whether to appear before the court, as the hearing will be held on January 13, 2027, and the result may condition the continuity of the granting procedure.
