Sescam excludes nine Librarian candidates due to lack of qualification

The Castilla-La Mancha Health Service (Sescam) has declared the exclusion of nine applicants from the selection process for entry, via the general open access system, into the category of Librarian for its health institutions, corresponding to the 2023-2024 Public Employment Offer (OEP). The decision was adopted by the General Directorate of Human Resources and Transformation through a resolution dated September 11, 2026, published in the Official Gazette of Castilla-La Mancha (DOCM) number 180, dated September 18, 2026 (reference 2026/6619). The reason is the failure to prove the qualification required in the call for applications.

A June 2025 call and a qualification requirement

The selection tests were announced via the Resolution of 06/23/2025 of the aforementioned General Directorate, published in DOCM number 123, dated June 30, 2025. The second base, section 1.c), requires possessing the academic qualification detailed in Annex I, issued by recognized official centers, or being in a position to obtain it by the end of the application submission period; in the case of degrees obtained abroad, their homologation or recognition by the competent ministerial department must be proven within that same period.

Annex I sets for the Librarian category the qualification of “University degree in Documentation or university degree in Information and Documentation or equivalent qualification.” The requirement must be held on the day the application period ends and maintained throughout the selection process until taking office as permanent statutory personnel, according to base Second.2.

The nine excluded applicants

Following the verification carried out at the request of the Qualifying Board of the selection process, the General Directorate declares the exclusion of:

  • Aparicio Duchel, Celia
  • Carpio Abad, Eva María
  • Corbacho Alonso, Nerea
  • García Magán, Ana
  • González Fernández, Pilar
  • Moreno Bodas, María Paz
  • Rosal Moral, María Isabel
  • Sánchez Sánchez, Álvaro
  • Vega Peinado, José Ignacio

The resolution applies base Second.3 of the call and relies on the Supreme Court Judgment number 823/2021, which establishes as an interpretive criterion that, in non-sanctioning procedures that adopt agreements restricting rights, the omission of the hearing procedure lacks an invalidating effect when it does not produce actual material defenselessness. The document maintains that, as it has been proven that the applicants do not possess the required qualification, this omission does not generate defenselessness.

Competencies and appeals processes

The resolution is issued in exercise of the powers delegated by section 6.5 of the Resolution of November 20, 2023, of the Management-Directorate of Sescam, on the delegation of powers (DOCM number 233, of December 5, 2023). The text is signed by the Director General of Human Resources and Transformation, Íñigo Cortázar Neira.

Against the resolution, which exhausts the administrative route, the following may be filed:

  • A contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Toledo, within a period of two months starting from the day following its publication in the DOCM.
  • An optional appeal for reversal (recurso de reposición) before the same body that issued it, within a period of one month, in accordance with articles 123 and 124 of Law 39/2015, of October 1.

Once the appeal for reversal has been filed, the contentious-administrative appeal may not be filed until the former has been expressly resolved or its presumed dismissal has occurred.

Impact on the selection process

The exclusion reduces the number of candidates continuing in the selection process for Sescam Librarian and forces those affected to decide within a fixed period whether to appeal the decision. Furthermore, the case highlights the requirement to prove the exact qualification listed in Annex I from the closing date of the application period, a requirement that Sescam now verifies with the qualifying tribunal before the examination phase.
