The SES forwards the file of the Maimona health center to the court

The Extremadura Health Service (SES) has agreed to remit the administrative file corresponding to the contentious-administrative appeal processed under ordinary procedure no. 105/2026, filed by UTE Urgacen Viena 25, SL, Ursa Infraestructuras, SL regarding the works of the Los Santos de Maimona Health Center, to the Court of First Instance, Contentious-Administrative Section, Plaza no. 1, of Mérida. The decision is formalized through the Resolution of September 16, 2026, from the SES Management Directorate, published in the Official Gazette of Extremadura (DOE) no. 182, of September 21, 2026, with official reference 2026062381. The same agreement summons potential interested parties to appear before the court if it is in their legal interest.
The resolution is issued in compliance with the request made by the judicial body itself and in accordance with the provisions of articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction. The document was signed in Mérida on September 16, 2026, by the Managing Director of the SES, Encarnación Solís Pérez.
The litigation refers to the contract for “Construction works of the Los Santos de Maimona Health Center,” identified by file CO/99/1122014750/22/PA, and accumulates several fronts of challenge before the contentious-administrative jurisdiction.
The object of the appeal
According to the published text, the legal representation of UTE Urgacen Viena 25, SL, Ursa Infraestructuras, SL directs its appeal against the following acts and proceedings:
- The presumed dismissal by administrative silence of 03/12/2026.
- The administrative inactivity of 12/02/2024.
- The material action of via de hecho (de facto action) due to the undue retention of 33,377.17.
- The invalidity of final certification no. 25 and the final measurement act of 12/04/2024.
- The express resolutions of 01/27/2026, 04/24/2026, and 05/13/2026.
Summons and appearance period
The SES agreement summons potential interested parties to appear before the Court of First Instance, Contentious-Administrative Section, Plaza no. 1, of Mérida within a period of nine days, counted from the day following the publication of the resolution in the DOE.
The resolution warns of the consequences of acting outside the deadline: anyone who appears once that term has elapsed will be considered a party only for the proceedings that have not precluded, and the procedure will continue through its steps without the need for notifications to be made in court or in any other manner.
The infrastructure in dispute
The contract subject to the litigation corresponds to the construction of the Los Santos de Maimona Health Center, in the province of Badajoz, a reference healthcare infrastructure for the region whose execution is linked to the development of these judicial proceedings. The administrative file has already been forwarded to the judicial body, a preliminary step to the processing of the case.
The publication of this type of resolution in the official gazette serves a dual purpose: it complies with the court’s requirement and serves as notification to all those who may have a legitimate interest in the proceedings, avoiding individual notifications.
The outcome of ordinary proceeding no. 105/2026 will determine the scope of the economic and contractual obligations derived from the health center works, as well as the validity of the contested final certification and measurement act. For the residents of Los Santos de Maimona and the corresponding health area, the litigation directly affects the commissioning and execution of a key healthcare facility; therefore, any delay resulting from the conflict has an impact on the public service.
