The SES forwards the appeal against the nursing pool to the court

The Extremadura Health Service (SES) has forwarded to the Court of First Instance, Contentious-Administrative Section, Plaza n.º 2, of Cáceres, the administrative file of the contentious-administrative appeal processed under abbreviated procedure no. 120/2026, directed against the job bank lists for the Nurse category. The decision is published in the Official Gazette of Extremadura (DOE) number 180, dated September 17, 2026, via the Resolution of September 11, 2026, from the General Directorate of Human Resources of the SES (reference 2026062351). The same announcement summons any interested parties to appear before the court within nine days.

Who is appealing and which lists are being challenged

The appeal is promoted by Ms. Lidia Gómez González, according to the official text. The lawsuit is directed against the dismissal by administrative silence of the appeal for reversal that the appellant filed on June 6, 2025. That appeal for reversal targeted the Resolution of May 6, 2025, from the Management Directorate, by which the final lists of admitted and excluded applicants regarding the merit assessment update cutoff of September 30, 2024, were made public.

The affected job bank is that of the Nurse category and for Special Characteristics Units of the same category, convened by the Resolution of September 23, 2014, from the Management Directorate. Therefore, this is a challenge affecting the merit cutoff that orders the lists of applicants for that job bank.

Nine days to appear before the court

The resolution agrees to the forwarding of the file and, at the same time, summons anyone with a legitimate interest in the procedure. The terms of the summons are as follows:

• Deadline: nine days.
• Calculation: from the day following the publication of the resolution in the DOE.
• Body before which to appear: Court of First Instance, Contentious-Administrative Section, Plaza n.º 2, of Cáceres.
• Consequence of appearing after the deadline: the interested party will be considered a party to the proceedings for the non-expired steps, and the procedure will continue through its steps without the need for notifications in court or by any other means.

Legal basis and issuing body

The resolution is issued in accordance with the provisions of articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, and complies with the request made by the court. The document was signed in Mérida on September 11, 2026, by the General Director of Human Resources, José Antonio Bote Paz.

The SES is the body that manages the job banks for the statutory personnel of the Extremaduran public health system, such that the contested lists affect the calling order of Nursing applicants.

The publication of this procedure is important for all applicants in the Nursing job bank and the Special Characteristics Units who wish to defend their position in the process: the resolution of summary proceeding 120/2026 may alter the final lists derived from the merit cutoff of September 30, 2024 and, consequently, the calling order. Those who do not appear within the nine-day period may continue to be party to the non-precluded proceedings, but will lose personalized notifications.
