Por FactBox Admin

The General Directorate of Human Resources of the Canary Islands Health Service has ordered the administrative file of the appeal filed by Nayra Hernández Gutiérrez against the results of the stabilization process for the category of Laboratory Specialist Technician to be sent to the Contentious-Administrative Section of the Court of First Instance of Las Palmas de Gran Canaria. The decision is detailed in the Resolution of August 14, 2026, published in the Official Gazette of the Canary Islands (BOC) no. 180, of September 8, 2026, which also summons the interested parties to appear in the proceedings.
The appeal is being processed under abbreviated procedure no. 416/2026 and stems from the official letter sent by the court on July 20, 2026, which was received by the General Directorate of Human Resources on July 29 of the same year. The resolution is issued in accordance with Articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
Object of the appeal
The appellant challenges the presumed dismissal of the administrative appeal (recurso de alzada) filed against the Resolution of the Coordinating Tribunal approving the final results of the competition phase of the exceptional selection process for the stabilization of long-term temporary employment (merit-based competition) for statutory personnel, category of Laboratory Specialist Technician.
Said process was convened by the Resolution of December 23 of the General Directorate of Human Resources of the Canary Islands Health Service, published in the BOC no. 255, of December 29, 2022. The appeal is also directed against the presumed dismissal of the appeal for reversal (recurso de reposición) filed against the Resolution of April 10, 2026, by the Director of the Canary Islands Health Service, regarding the appointment as permanent statutory personnel in vacant basic positions of the category of Laboratory Specialist Technician, Health Group C/C1, published in the BOC no. 76, of April 21, 2026.
Content of the resolution
The adopted resolution contains two main agreements:
- Remittance of the file to the Contentious-Administrative Section of the Court of First Instance of Las Palmas de Gran Canaria, Court no. 1, corresponding to abbreviated procedure no. 416/2026.
- Summons of the interested parties so that they may appear and formally present themselves before the aforementioned court within a period of nine (9) days from the date of publication of the announcement in the Official Gazette of the Canary Islands.
The resolution is signed in Las Palmas de Gran Canaria, on August 14, 2026, by the Director General of Human Resources, José Ángel González Díaz.
Relevance of the procedure
The announcement is part of the exceptional process for the stabilization of long-term temporary employment promoted by the Canarian Health Service, a merit-based competition aimed at consolidating statutory staff positions within the Canarian health sector. The judicial challenge of the results of the competition phase directly affects the filling of vacant basic positions in the category of Laboratory Specialist Technician, a key profile in the clinical analysis services of hospital centers and primary care centers across the islands.
The summons opens a nine-day window for any person with a legitimate interest in the procedure to appear, thereby guaranteeing the right to effective judicial protection for those who participated in the selection process. The judicial resolution that is eventually issued may condition the validity of the appointments made and the development of future stabilization calls within the Canarian public health system.
