The SCS refers the stabilization proceedings of the C/C1 Group to the courts

The Canary Islands Health Service (SCS), through its General Directorate of Human Resources, has agreed to remit to the Contentious-Administrative Section of the Court of First Instance of Las Palmas de Gran Canaria the file of the contentious-administrative appeal being processed under abbreviated procedure no. 382/2026. The decision is detailed in the Resolution of July 30, 2026, published in the Official Gazette of the Canary Islands no. 175, of September 1, 2026, which also summons the interested parties to appear before the court.
The appeal has been filed by Ms. María Concepción Pérez Afonso against the dismissal by administrative silence (presumed act) of the administrative appeal filed against the resolution of the Coordinating Tribunal approving the final results of the competition phase of the exceptional selection process for the stabilization of long-term temporary employment (merit competition) for statutory personnel. The Resolution of April 15, 2026, issued by the Director, regarding the appointment as permanent statutory personnel in vacant basic positions in the category of Administrative Group of the Administrative Function, Group C/C1 Management and Services, published in the BOC no. 81, of April 28, 2026, is also contested.
Origin of the procedure
The official letter from the Contentious-Administrative Section was received by the General Directorate of Human Resources on July 16, 2026, initiating the processing of the file. The remittance is ordered in accordance with Articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction, which require the Administration to send the complete file to the judicial body.
The object of the litigation is the process for the stabilization of long-term temporary employment, an extraordinary mechanism for the consolidation of positions affecting the category of Administrative Group C/C1 Management and Services of the statutory personnel of the SCS.
Remittance of the file and summons
The resolution orders two main actions:
- Remit the complete administrative file to the Contentious-Administrative Section of the Court of First Instance of Las Palmas de Gran Canaria, Plaza no. 1.
- Summon the interested parties so that they may appear and formally enter the abbreviated procedure no. 382/2026 in due legal form.
The deadline for appearance is nine (9) days from the date of publication of the announcement in the Official Gazette of the Canary Islands, that is, from September 1, 2026.
Signature and scope
The announcement, included in the Other announcements section of the Department of Health, is signed in Las Palmas de Gran Canaria on July 30, 2026, by the Director General of Human Resources, José Ángel González Díaz. The publication allows any person with a legitimate interest in the stabilization process of Group C/C1 to become aware of the existence of the litigation and exercise their right to appear.
The judicial resolution eventually issued in proceeding 382/2026 may affect the validity of the results of the merit competition and the appointments derived from the stabilization; therefore, it is of particular interest to the applicants and to the permanent statutory staff already appointed to the Administrative Group C/C1 category.
