The SCS refers the appeal of a laboratory applicant to the courts

The General Directorate of Human Resources of the Canary Islands Health Service (SCS) has agreed to remit to the Contentious-Administrative Section of the Court of First Instance of Las Palmas de Gran Canaria the administrative file of the appeal filed by Ms. Nayra Hernández Gutiérrez against the results of the merit-based competition for the stabilization of the category of Laboratory Specialist Technician. The decision is detailed in the Resolution of August 14, 2026, published in the Official Gazette of the Canary Islands (BOC) No. 180, dated September 8, 2026, which also summons the interested parties to appear in the proceedings.
The appeal is being processed under abbreviated procedure No. 416/2026, handled in Courtroom No. 1 of the aforementioned court. The remittance occurs following the judicial order of July 20, 2026, which was received by the General Directorate on July 29 of the same year, and is ordered in accordance with Articles 48 and 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.
Object of the appeal
The plaintiff challenges two administrative actions from the exceptional selection process for the stabilization of long-term temporary employment (merit-based competition) for statutory personnel:
- The presumed dismissal of the administrative appeal filed against the Resolution of the Coordinating Tribunal approving the final results of the competition phase for the category of Laboratory Specialist Technician, convened by the Resolution of December 23 of the General Directorate of Human Resources of the SCS (BOC No. 255, of 12.29.2022).
- The presumed dismissal of the request for reversal against the Resolution of April 10, 2026, by the Director of the SCS, regarding the appointment as permanent statutory personnel in vacant basic positions of the category of Laboratory Specialist Technician, Health Group C/C1 (BOC No. 76, of 4.21.2026).
Summons to interested parties
The resolution orders the summons of the interested parties so that they may appear and present themselves in abbreviated procedure No. 416/2026, in legal form and within a period of nine (9) days from the date of publication of the announcement in the Official Gazette of the Canary Islands.
The announcement, corresponding to number 3189 of the other announcements section of the Ministry of Health, was signed in Las Palmas de Gran Canaria on August 14, 2026, by the General Director of Human Resources, José Ángel González Díaz.
Relevance of the process
The publication of this notice allows the applicants affected by the merit-based competition for the stabilization of the Specialist Laboratory Technician category to become aware of the existence of the litigation and exercise their right to appear in the proceedings. The judicial resolution issued may affect the validity of the final results of the competition phase and the appointments derived from a process that affects the consolidation of long-term temporary employment in the Canarian public health system.
