La Rioja's Health Service (Salud riojano), facing four lawsuits over continuous care supplements

The Riojan Health Service has published four summonses to potential interested parties in respective abbreviated proceedings before the Contentious-Administrative jurisdiction of Logroño. The announcements, signed by the Human Resources Directorate of the organization’s Management, appear in the Official Gazette of La Rioja number 182, dated Tuesday, September 22, 2026, within section III, Other Provisions and Acts. The files affect healthcare personnel claiming the payment of continuous care salary supplements and one applicant whose petition was dismissed.

Four proceedings before the courts of Logroño

The summonses respond to decrees issued by the judicial bodies between September 9 and 16, 2026, and are addressed to anyone who may have the status of an interested party in each process. In all cases, the defendant is the Riojan Health Service and the appearance period is identical.

The object of the claims

Three of the proceedings—numbers 200, 201, and 202 of 2026—share the same object: the request for payment of the continuous care salary supplement in its A and B modalities, corresponding to night shifts and holidays, during the vacation period. These are, therefore, salary claims from personnel who provide services on night shifts and public holidays.

The fourth file, P.A. 208/2026, has a different object. It refers to the resolution of January 27, 2025, from the Human Resources Directorate of the Management of the Riojan Health Service, which dismissed the request submitted by María Arrate Hernández Martínez on July 30, 2024. The plaintiff is now challenging that refusal before Contentious-Administrative Section number 2.

Period of nine business days and effects of non-appearance

The four notices reproduce the same procedural warning. Potential interested parties must appear before the judicial body within nine business days starting from the day following the notification of the summons. If they fail to do so, the proceedings will continue without any further notification being served to them, and the summons will be incorporated into the administrative file, which will be forwarded to the requesting judicial body.

The texts appear signed in Logroño by the Director of Human Resources, María Begoña Lema De Pablo, dated September 16 and 17, 2026, according to the file. The publication of these summonses has direct relevance for all personnel of the Riojan Health Service: any professional in an analogous situation—remuneration for continuous care during vacations or requests dismissed by the Human Resources Directorate—may be affected by the resolution of these processes and has a short period of time to appear. Furthermore, the coincidence of three lawsuits with an identical objective suggests a remuneration conflict of collective scope, beyond the four individual cases published.
