El Masnou opens the process to appoint the substitute justice of the peace

The City Council of Masnou has initiated the procedures for the appointment of the substitute Justice of the Peace for the municipality, according to the announcement published in the Official Gazette of the Province of Barcelona on September 21, 2026 (CVE 202610141307). The decision was formalized through mayoral decree number 2026LLDA003323, dated September 15, 2026, and the position will be held by whoever obtains the favorable vote of the absolute majority of the members composing the Plenary of the corporation. Applicants have 15 business days to submit their candidacy.

The Justice of the Peace is the judicial figure who exercises their functions in municipalities where there is no court of first instance. The appointment is the responsibility of the City Council Plenary, but the designation is subsequently formalized by the Governing Chamber of the High Court of Justice of Catalonia, in accordance with articles 101, 102, and 103 of the Organic Law 6/1985, of July 1, of the Judiciary (LOPJ), and the Regulation 3/1995, of June 7, of the Justices of the Peace. The mandate is for four years and the position is remunerated according to the legally established system and amount.

The call in Masnou joins other similar processes published in the same provincial gazette in recent days, such as those of Sant Vicenç de Montalt and Orpí, reflecting the periodic renewal of these positions throughout the province.

The decree and the election procedure

The municipal file is processed under number X2026021390 and was electronically signed by the mayor, Jaume Oliveras Maristany, on September 15, 2026. The announcement is published in the local administration section of the gazette, dated September 21, 2026.

Requirements to be a candidate

To be elected, one must have Spanish nationality, be of legal age, and not fall under any of the causes of incapacity or incompatibility provided by law for exercising these positions. The announcement literally reproduces article 303 of the LOPJ, according to which the following are incapacitated from entering the judicial career:

• Those physically or mentally incapacitated for judicial function.
• Those convicted of an intentional crime until they have obtained rehabilitation.
• Those prosecuted or indicted for an intentional crime until they are acquitted or a dismissal order is issued.
• Those who are not in full exercise of their civil rights.

Additionally, the text specifies that retired persons may be appointed, provided they are not incapacitated from the position.

Deadline and submission of applications

Persons interested in applying as candidates must submit their application to the general entry registry of the Ajuntament del Masnou within a period of 15 business days, counted from the day following the publication of the announcement in the Butlletí Oficial de la Província de Barcelona.

The application must be accompanied by the following documentation:

• The applicant’s DNI.
• The curriculum vitae, including studies completed, occupations, and public and social activities.

The appointment of the substitute justice of the peace guarantees the continuity of the local judicial service in the municipality and directly affects the residents who attend for small claims matters, conciliations, and other functions attributed to these bodies by law.
