El Juzgado número 4 de Cádiz revisa la corrección de siete plazas municipales

The Cádiz City Council has summoned all those who appear as interested parties in the summary proceeding 339/2025, which is being conducted before the Contentious-Administrative Section of the Cádiz Court of First Instance, court number 4, against the grading of an exam from the selection process for seven Administrative Assistant positions. The announcement, registered under number 365.549, is published in the Official Gazette of the Province of Cádiz (BOP) number 212, corresponding to November 4, 2026. Affected parties have a period of nine days to appear in legal form.

The origin of the litigation is the contentious-administrative appeal filed by Aurora Tamayo Fernández against the presumed dismissal of the administrative appeal (recurso de alzada) that she had submitted on April 17, 2025, to the Cádiz City Council. In that document, she requested the annulment of the grading of the exam published on April 10, 2025, regarding the selection process for 7 Administrative Assistant positions included in the Public Employment Offer OEP 2016-2017.

The Cádiz City Council appears in the proceeding as the defendant Administration. To this end, it has forwarded the official notice sent by the Contentious-Administrative Court number 4 of Cádiz, in which the City Council is required to issue the summons to all persons who may have the status of interested parties and, in this way, may appear as defendants in the appeal.

The object of the litigation

Summary proceeding 339/2025 does not challenge the entirety of the call for applications, but rather a specific act of the selection process: the grading of the exam published on April 10, 2025, for the 7 Administrative Assistant positions of the OEP 2016-2017. The appellant first requested the annulment of that grading through administrative channels via an administrative appeal.

Given the silence of the Cádiz City Council, the dismissal is understood to have occurred by presumed rejection, which opened the door to the contentious-administrative jurisdiction. The appeal is processed through the channels of the summary proceeding in the Contentious-Administrative Section of the Cádiz Court of First Instance, court number 4.

The summons is issued in accordance with articles 44 and 45 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations, and article 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.

Nine-day period and form of appearance

The announcement sets the conditions of the procedure for those who prove a legitimate interest in the outcome of the lawsuit:

  • Deadline: nine days starting from the day following the publication of the announcement in the BOP.
  • Body before which the appearance is made: the Contentious-Administrative Section of the Cádiz Court of First Instance, court number 4.
  • Procedural position: the appearance is made as the defendant, as indicated in the judicial notice sent to the City Council.
  • Publication of the summons: Official Gazette of the Province of Cádiz number 212, dated November 4, 2026, announcement number 365,549.

The document was signed on October 19, 2026, by the Director of the Personnel Area of the Cádiz City Council, Marina del Pilar Jiménez Rivas, by delegation of the Secretary General.

Consequences of failing to appear

The text warns that appearing after the indicated deadline does not prevent intervention, but limits the interested party to the procedures that have not yet expired. In other words, whoever arrives late will remain a party only for subsequent proceedings, without the possibility of reversing what has already been acted upon.

If the interested party does not appear in a timely manner, the procedure will continue through its stages without any notification being issued to them, in accordance with Article 50 of Law 29/1998. This provision makes the appearance within the nine-day period the only channel to follow the development of the lawsuit and defend one’s own position.

The publication in the BOP thus serves as a collective notification to those who, being candidates in the 2016-2017 process, may be affected by an eventual annulment of the exercise correction.

Impact for the candidates

Resolution 339/2025 may alter the correction of an already published exercise and, consequently, the situation of the applicants who participated in the process for the 7 Administrative Assistant positions. Candidates who consider themselves affected have the nine-day period to appear and defend their position before the Cádiz Court of First Instance; those who do not do so will remain outside a procedure that will move forward and whose judgment could impact their expectations of accessing municipal public employment.
