The municipal processing complied with articles 6 and following of Decree 8/2015, of February 5, for the streamlining and modernization of the management of the assets of Canarian local corporations.
On the regional side, the body incorporated the mandatory report from its Legal Services into the file, and the President issued Resolution No. 288/2026, of August 25, 2026, by which the transfer was accepted, in accordance with Article 78 bis of Decree 133/1988, of September 22. The agreement is supported by Article 300.1.b).2 of Law 4/2017, of July 13, on Land and Protected Natural Spaces of the Canary Islands, in relation to Article 31 of Law 2/2003.
Commitments and registration effects
The clauses of the agreement establish that the City Council of the Villa de Los Silos transfers the plot free of charge and that the Canarian Housing Institute accepts it, committing to carry out the necessary actions to designate it for publicly promoted protected housing. The agreement constitutes sufficient title to register the transfer in the Property Registry, according to Article 2 of the Mortgage Law and Article 79.2 of Decree 133/1988, and may be elevated to a public deed at the request of either party, with the notary and registration costs borne by the party requesting it.
The document is signed by the Director of the Canarian Housing Institute, María del Pino de León Hernández, appointed by Decree 15/2026, of February 23, and by the Mayor-President of the City Council of the Villa de Los Silos, Carmen Luz Baso Lorenzo.
The operation strengthens the public land assets of the archipelago with a plot already classified as urban and free of encumbrances, ready for construction. In a context of housing tension in the islands, the incorporation of this municipal land into the public promotion park allows the Canarian Housing Institute to move forward with the construction of protected housing in northern Tenerife.
