The INE cancels the registration of four national political groups

The General Council of the National Electoral Institute resolved the loss of registration of four national political groups for failing to prove any activity during the 2018 fiscal year. The determination is contained in Resolution INE/CG24/2022, within case file UT/SCG/Q/CG/191/2019, and is published in the Official Gazette of the Federation on Friday, September 18, 2026, Section I, pages 232 to 265.

The legal framework of the sanction

The resolution is based on Article 22, paragraph 9, subsection d) of the General Law of Political Parties, which establishes the loss of registration for a national political group that fails to prove any activity during a calendar year. The applied sanction is the cancellation of registration, provided for in Article 456, paragraph 1, subsection b), fraction III of the General Law of Electoral Institutions and Procedures, and its publication in the Official Gazette of the Federation complies with Article 95, paragraph 2 of the General Law of Political Parties.

The origin of the case is Resolution INE/CG474/2019, approved unanimously on November 6, 2019, based on the Consolidated Report of the review of the annual income and expenditure reports of the political groups corresponding to 2018. That ruling notified the Executive Secretariat of the Institute, which registered the case file on December 16, 2019.

The sanctioned groups

• Concordancia hacia una Democracia Social: submitted its annual report with zero values and failed to prove any activity or respond to the request from the auditing authority.
• Ricardo Flores Magón: failed to prove any activity; the renewal of its national leadership was not considered an activity directed toward the development of democratic life and political culture.
• Rumbo a la Democracia: failed to perform or prove any activity during 2018 and did not respond to the summons.
• Unidad Nacional Progresista: its photographic evidence corresponded to activities organized by the Institute itself, which it only attended as a guest.

The fifth group mentioned, Decisión con Valor, was exempt from sanction: the General Council considered it proven that its president, Oswaldo Luna Alatorre, took and passed the “Diploma Course on Political Violence against Women based on Gender,” taught by the National Autonomous University of Mexico by invitation of the Institute.

The procedure and the defense

The ordinary sanctioning procedure was admitted on November 25, 2020, and the groups were summoned between November and December of that year. Decisión con Valor, Ricardo Flores Magón, and Unidad Nacional Progresista answered the summons; Concordancia hacia una Democracia Social and Rumbo a la Democracia failed to do so, and therefore their right was considered forfeited.

The deadlines were suspended due to the COVID-19 health emergency and were reactivated by agreement on September 2, 2020. The Technical Oversight Unit and the General Executive Board intervened in the review of the reports and in the proposal for the loss of registration.

Special gravity and effects

The General Council classified the offense as being of special gravity and intentional, considering that the groups were aware of their obligations and failed to comply; no recidivism was recorded. It was concluded that a public reprimand or a fine would be insufficient, therefore the cancellation of the registration was appropriate.

The resolution was approved in an extraordinary session on January 26, 2022, by a unanimous vote of the electoral councilors, signed by the presiding councilor Lorenzo Córdova Vianello and the secretary of the General Council, Edmundo Jacobo Molina. An appeal may be filed against this determination, which must be submitted within four days following its notification.

The loss of registration leaves these organizations without legal existence as national political groups, with effects on their membership and on the public funding they received. The resolution emphasizes that the cancellation seeks to deter non-compliance with the purposes for which they were established: to contribute to the development of democratic life and the political culture of the country.
