The Government appoints Fuensanta Alcalá Luque as Director General of Housing Discipline

The Government of Catalonia has agreed to appoint Fuensanta Alcalá Luque as Director General of Housing Discipline of the Department of Territory, Housing and Ecological Transition, with effect from 1 August 2026. The appointment is published in Decree 142/2026, of 28 July, in the Official Journal of the Government of Catalonia (DOGC) No. 9719, of 30 July, the same issue that creates this directorate general and renews the Legal Advisory Commission.

The appointment is processed in accordance with Article 26.h of Law 13/2008, of 5 November, on the presidency of the Government and the Government of Catalonia, at the proposal of the Minister of Territory, Housing and Ecological Transition, Sílvia Paneque i Sureda, and with the agreement of the Government. The decree is signed by President Salvador Illa i Roca, acting as deputy for the Minister of the Presidency, Albert Dalmau Miranda, by virtue of Decree 112/2026, of 21 July.

A newly created directorate general

The new directorate general arises from Decree 130/2026, of 28 July, also published in DOGC 9719, which amends Decree 242/2025, of 4 November, on the restructuring of the Department of Territory, Housing and Ecological Transition. The reform transfers to the department the inspection and sanctioning powers in housing matters previously exercised by the Catalan Housing Agency, following the amendment of Law 13/2009 introduced by Law 11/2026, of 9 July, on fiscal, financial, administrative and public sector measures. The declared objective is to strengthen the effectiveness of housing policies and ensure compliance with sectoral regulations.

The body, which reports to the Housing Secretariat, centralises housing discipline with functions such as:

• Directing and coordinating inspection, the processing of sanctioning procedures and the execution of resolutions.
• Establishing criteria on unoccupied dwellings, overcrowding, substandard housing, large landlords, officially protected housing, certificates of habitability, urban leases and rent control.
• Exercising the sanctioning power and initiating and resolving the corresponding sanctioning proceedings.
• Promoting the restoration of legality and coordinating with other administrations, especially local bodies.

Three services are integrated under the new body:

• Housing Inspection Service.
• Sanctioning Regime Service for Habitability, Rentals and Residential Conservation.
• Sanctioning Regime Service for Officially Protected Housing and Housing Users.

Decree 130/2026, which came into force on the same day of its publication, abolishes the Procedure and Disciplinary Regime Service of the Housing Secretariat.

Renewal by thirds of the Legal Advisory Commission

The same DOGC 9719 publishes Decree 141/2026, of 28 July, on the cessation, renewal and appointment of members of the Legal Advisory Commission. According to article 3.3 of Law 5/2005, of 2 May, the Government appoints members for a period of six years, renewable for another six, and renewal is done by thirds every two years.

With the new decree, three members cease, one is renewed and three are appointed:

• Cease, with thanks for the services rendered: Albert Lamarca i Marquès, Esther Arroyo Amayuelas and Agustí Cerrillo i Martínez.
• Renewed: Judith Gifreu i Font.
• Appointed: Manuel-Odón Mallo Gómez, Josep Maria Aguirre i Font and Belén Noguera de la Muela.

Impact

With the new structure, the Generalitat concentrates in a single management body the inspection and sanctioning in housing matters, an area where rent control, empty homes and substandard housing occupy the center of the public agenda. The appointment of Alcalá Luque, effective 1 August, operationally sets in motion an organizational design intended to streamline sanctioning procedures and strengthen the protection of housing users.
