The State expropriates 83 square meters for the new Cabezuela bridge

The Ministry of Transport and Sustainable Mobility, through the State Road Demarcation in Extremadura, has called for the drawing up of records prior to the occupation of assets and rights affected by the expansion of expropriations for modification no. 2 of the new N-110 bridge in Cabezuela del Valle. The act will be held on September 29, 2026, starting at 11:30 a.m., at the Cabezuela del Valle Town Hall. The announcement is published in the Official Gazette of the Province of Cáceres no. 0178, dated September 17, 2026, with reference CVE BOP-2026-4347 (pp. 21457-21459).

The file stems from the final approval of the layout project. On July 1, 2021, the Secretary of State for Infrastructure, Transport and Housing, by delegation of the Minister of Public Works (Order FOM/1644/2012, amended by Order FOM/1356/2016), approved the public information file and definitively the Layout Project “New Bridge on the N-110 road in Cabezuela del Valle”, with key 28CC-3530. The technical approval of modification no. 2 occurred by resolution of the Director General of Roads on April 7, 2026.

Article 12.2 of Law 37/2015, of September 29, on Roads establishes that the final approval of State road projects implies the declaration of public utility and the need for the occupation of assets, the modification of services, and the acquisition of rights for expropriation purposes. Paragraph 4 of the same provision extends this declaration, as an urgent occupation, to the assets included in the project layout, the replacement of affected services, and any subsequent approved work modifications. The processing complies with articles 52 and following of the Law of December 16, 1954, on Compulsory Expropriation, and its Regulation of April 26, 1957.

A single affected property

The list published in the announcement is limited to one property in the municipality of Cabezuela del Valle, with the following data:

The Demarcation acts in exercise of the powers of article 98 of the Compulsory Expropriation Law and in accordance with rules 2 and 3 of its article 52.

Appearance and notification

The holders of the assets and rights being expropriated must appear in person or be represented by a duly authorized person, providing documents proving their ownership, and may be accompanied, at their own expense, by experts and a notary. The Demarcation had already notified the interested parties of the prior hearing process and the proposed expropriation resolution, with the final resolution being issued after the granted period.

In addition to the individual summons, the appointment will be communicated through announcements in the Official State Gazette (Boletín Oficial del Estado), the Official Gazette of the Province of Cáceres, the notice board of the Cabezuela del Valle City Council, and one of the highest-circulation newspapers in the province. Pursuant to Article 44 of Law 39/2015, of October 1, this publication serves as notification to potential unidentified interested parties, unknown owners, and those whose whereabouts are unknown.

Allegations and Consultation of Plans

Until the time the preliminary records are drawn up, interested parties may submit in writing any allegations they deem appropriate to the State Road Demarcation in Extremadura, Cáceres Road Unit, located at Avenida Ruta de la Plata no. 11, 10071 Cáceres, or through the electronic office, according to Article 56.2 of the Compulsory Expropriation Regulations.

The parcel plans and the list of interested parties and affected assets may be consulted at the offices of the City Council and the Demarcation, as well as in the public participation section of the Ministry’s website, in compliance with Article 83.2 of Law 39/2015. The announcement was signed in Cáceres, on September 9, 2026, by Antonio J. Ruiz-Roso Gómez, chief engineer of the State Road Demarcation in Extremadura.

The announcement opens the practical period for affected owners in Cabezuela del Valle to review the expropriated area and present allegations before the records are drawn up, a step prior to the effective occupation of the land and the payment of the fair price (justiprecio). Since this is an expropriation under the urgency procedure, occupation may occur without waiting for the final determination of the price.
