The Sierra Procomunal Albacete-Chinchilla Consortium approves its new statutes

The Sierra Procomunal Albacete-Chinchilla Consortium has definitively approved its statutes, which regulate the joint management of the Sierra Procomunal rural estate, shared by the city councils of Albacete and Chinchilla de Montearagón. The agreement, adopted by the Consortium’s Governing Council on June 16, 2026, and ratified by the plenums of both municipalities, is published in full in the Official Gazette of the Province of Albacete number 107, dated September 14, 2026, in the third section of Local Administration.

The initial approval was subject to public consultation for thirty days following the publication of the announcement in BOP number 86, dated July 27, 2026, without any objections being filed; therefore, the agreement is considered definitive. The text replaces the statutes approved in 1994 and expressly repeals those published in the BOP of Albacete on May 6, 1994, as well as subsequent modifications.

Nature and Purpose of the Consortium

The Consortium, established in 1994, is a public law entity with its own distinct legal personality, attached to the City Council of Chinchilla de Montearagón, with headquarters at San Julián Street, number 2, in said town. Its purpose is the management, administration, conservation, defense, improvement, and utilization of the Sierra Procomunal estate, as well as the resources, facilities, and uses compatible with its nature.

Its primary objectives include:

• The unitary and efficient administration of the estate and its resources.
• The conservation, protection, and improvement of the common heritage.
• The regulation of agricultural, forestry, livestock, hunting, and other legally compatible uses.
• The generation of sustainable economic returns in compliance with applicable regulations.
• The preservation of the balance between patrimonial, environmental, and economic interests.

Governing Bodies

The Consortium is structured into five bodies: the Presidency, the Vice-Presidency, the Governing Council, the Secretariat, and the Comptrollership. The Presidency corresponds to the Mayor’s Office of Chinchilla de Montearagón, while the Vice-Presidency falls to the Mayor’s Office of Albacete or the council member to whom they delegate.

The Governing Council, the highest administrative body, is composed of an equal number of members appointed by each entity, with a maximum of six. It shall meet in ordinary session at least once per quarter, and its agreements shall be adopted by simple majority, with the Presidency holding a casting vote in the event of a tie. The functions of public certification and economic-financial control are carried out by officials with national authorization from the attached city council.

Economic and Patrimonial Regime

The Consortium’s resources derive from ordinary and extraordinary contributions from the consortium entities, income derived from the use of the estate, grants, donations and bequests, and private law income that legally accrues. The Consortium shall annually approve its budget, which will be integrated into the budgetary framework of the attached entity, in accordance with Article 122 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector.

Asset management and procurement shall be subject to public sector legislation, and personnel may be civil servants or contractual staff, resulting from the reallocation of positions from the consortium administrations. The modification of the statutes shall require ratification by the plenums of both entities, and dissolution may be agreed upon due to the fulfillment of purposes, supervening impossibility, unanimous agreement, or the exercise of the right of separation.

Relevance

The entry into force of these statutes, signed by the president of the Consortium, José Martínez Correoso, in Chinchilla de Montearagón on September 9, 2026, provides an updated legal framework for the management of a shared-ownership forest, guaranteeing inter-administrative cooperation and the asset and environmental sustainability of the Sierra Procomunal for the residents of both municipalities.
