The Sax City Council announces the election of a substitute justice of the peace

The Sax City Council has called for the selection process for a Substitute Justice of the Peace, following the vacancy of the position due to the resignation of the current holder. The Plenary of the Corporation will choose the person to be appointed to the position, in accordance with the provisions of articles 101 and 102 of Organic Law 6/1985, of July 1, of the Judiciary, and articles 4 and 5.1 of Regulation 3/1995, of June 7, of the Justices of the Peace.

The call is published in the Official Gazette of the Province of Alicante, number 169, of September 7, 2026, within section III of Local Administration, under reference 6760/2026.

Deadline and method of submission

Interested parties who meet the legal requirements may submit their written application addressed to the Mayor’s Office within a period of ten business days, which will begin to count from the day following the publication of the announcement in the official gazette.

• Applications must be submitted by electronic means.
• The official application form is attached to the announcement.
• The application includes a sworn statement regarding identification data and conditions of capacity and compatibility.

Requirements and compatibilities

Applicants must prove that they meet the capacity requirements established in Regulation 3/1995 (Article 1.2 of Title I and Article 13 of Title II) and that they do not incur the incompatibilities and prohibitions regulated in articles 389 to 397 of the Organic Law of the Judiciary. The main incompatibilities include:

• Any popularly elected office or political appointment of the State, autonomous communities, provinces, and local entities.
• Jobs or positions funded or remunerated by the State Administration, the General Courts, the Royal Household, autonomous communities, provinces, municipalities, and dependent entities.
• The practice of law, court representation (procuraduría), and all types of legal advice, whether remunerated or not.
• Membership in political parties or trade unions, as well as employment in their service.

Selection in the absence of applications

In the event that no applications are submitted, the Plenary of the Corporation will freely choose the person who will hold the office, in accordance with the provisions of article 101.1 of Organic Law 6/1985 and articles 4 and 6 of Regulation 3/1995. The agreement will be communicated to the Court of First Instance of the corresponding judicial district.

The call is published for the general knowledge of the residents of Sax, who may apply for a position of relevance in the local administration of justice, responsible for conciliation functions and certain jurisdictional acts in the municipality.
