Execution of the judgment annulling the competition for health pharmacists

The General Directorate of Personnel of the Department of Health has resolved, as of September 4, 2026, to continue with the selection process for the senior technical body of health administration, scale of health administration pharmacists (A1-S02-02), in compliance with the interlocutory orders issued in execution incidents of the Final Judgment 214/2024 of the High Court of Justice of the Valencian Community. The resolution is published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10447, of September 9, 2026, with reference DOGV-C-2026-28403.

Judicial Background

Judgment 214/2024, of February 28, 2024, issued in ordinary procedure 536/2021 of the 2nd Section of the Contentious-Administrative Chamber of the TSJCV, annulled the resolutions of May 4 and 14, 2021, of the Director General of Human Resources, which called for the competitive examination for the provision of vacancies in the scale of health administration pharmacists, as well as all administrative acts derived therefrom (DOGV 10282, 01.16.2026).

Subsequently, by orders of April 30 and July 29, 2026, the TSJCV declared “passed in good faith” only those successful candidates who had requested it in the judgment execution incident, recognizing their right to be awarded the corresponding vacancy on a permanent basis.

Scope of the Resolution

The resolution is based on Article 118 of the Spanish Constitution, which mandates compliance with final judgments, and Article 18 of Organic Law 6/1985, of July 1, of the Judiciary, as well as Articles 103 and concordant articles of Law 29/1998, regulating the contentious-administrative jurisdiction. Competencies are exercised in accordance with Article 18 of Decree 22/2025, of February 11, of the Consell, which approves the Organic and Functional Regulations of the Department of Health.

Consequently, it is ordered to continue the selection process regarding the candidates considered “passed in good faith,” listed in the annex of the resolution, and the Department of Health will publish the call for the single act of destination selection on its website.

Affected Candidates

The annex contains the final resolution of the competitive examination in the open entry turn, with nine candidates eligible for a position:

The annex also includes a list of two excluded persons: Margarita Haro Salinas (for not meeting the requirements) and José Vicente Real Soler (due to exclusion from obtaining a position in the 2017 consolidation selection process).

Impact

The resolution closes a long legal dispute that directly affected the applicants of the competitive examination for health administration pharmacists, guaranteeing the full execution of the judicial ruling and the definitive awarding of vacancies to those recognized “in good faith.” The publication of the single act of destination selection on the Department of Health website will mark the next step for those affected.
