Education summons interested parties in the litigation over an interim worker in Calahorra

The General Directorate of Educational Management of the Government of La Rioja has summoned potential interested parties in abbreviated procedure number 209/2026, which is being processed before the Court of First Instance, Contentious-Administrative Section, Court Number 1 of Logroño, against the Department of Education and Employment. The summons is formalized through Resolution 39/2026, dated September 28, published in the Official Gazette of La Rioja number 188, dated September 30, 2026, within section III. The appeal was filed by the interim civil servant Emilio Francisco García Roza after the Administration declared his service relationship at the Elementary Music Conservatory of Calahorra terminated.

Abbreviated procedure 209/2026 originates from the Resolution of September 15, 2025, of the General Directorate of Educational Management, which declared the obligation imposed by Judgment number 246/2021, issued by the Contentious-Administrative Court number 2 of Logroño in abbreviated procedure 0000008/2021, terminated. That judgment had maintained the continuous service relationship with the interim civil servant Emilio Francisco García Roza at the Elementary Music Conservatory of Calahorra.

Against that decision, the interested party filed an administrative appeal (recurso de alzada), which was dismissed by the Resolution of the Counselor of Education and Employment of May 22, 2026. Against this latter resolution, the contentious-administrative appeal has been filed, which now motivates the summons.

The court requirement and the deadline to appear

The Contentious-Administrative Court number 1 of Logroño required the Administration to submit the complete administrative file, as well as to carry out the necessary summons, in compliance with Article 49 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction.

By virtue of that requirement, potential interested parties are summoned to appear before the judicial body, if it serves their legal interests, within a period of 9 business days starting from the day following the publication in the Official Gazette of La Rioja.

Warning and effects of non-appearance

The resolution warns that, if the interested parties do not appear, the procedure will continue without any further notification being issued to them. They are further notified that this summons will be incorporated into the administrative file, which will be forwarded to the requesting judicial body.
