Board of Trustees of the Archaeological Museum of Puerto de la Cruz Dissolved

The Puerto de la Cruz City Council has made final the agreement to dissolve the Archaeological Museum Board and integrate the services corresponding to said museum into the municipal corporation itself. The decision, initially adopted by the Plenary on May 25, 2026, becomes firm as no claims or suggestions were submitted during the public exhibition period, and is published in the Official Gazette of the Province of Santa Cruz de Tenerife, number 104, dated August 31, 2026.

The announcement, with reference 1766759 and file 8726/2019, is issued via Decree number 2026-0901 of the Mayor’s Office, dated August 26, 2026, in compliance with article 9.3 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector. The dissolution is justified by a change in the management method based on the principles of efficacy and efficiency.

Change of management model

The plenary agreement approved the dissolution of the Board and the integration of the museum’s services into the City Council, repealing the organization’s statutes, which were approved by plenary agreement on April 26, 1990. The City Council universally succeeds the Board regarding all assets and collections, as well as all rights obtained under any title.

The assets forming part of the archaeological heritage and those of any other nature shall remain in the same premises where they are currently located.

Subrogation of workers and heritage

The City Council subrogates into the position of employer regarding the workers providing services to the Board, in accordance with article 44 of the consolidated text of the Workers’ Statute Law, effective at the moment of final dissolution. To this end, the corresponding adjustments must be made to the Staffing and the Job Position List.

• The Board’s current accounts are cancelled, with their balances transferred to the City Council.
• All existing accounting rights and obligations are transferred.
• The City Council subrogates into the ownership of the data files, notifying the Spanish Data Protection Agency.

Participation and subsequent procedures

The agreement provides for channeling the participation of the Institute of Hispanic Studies in the operation and decision-making affecting the museum, and may include the presence of other institutions, professionals, or organizations at the local, island, and regional levels.

Notice of the dissolution shall be given to the General State Administration, the Autonomous Community of the Canary Islands, the Island Council of Tenerife, the Social Security, and the Historical Heritage Council of the Canary Islands, as the highest advisory body on historical heritage matters. Against this agreement, interested parties may file a contentious-administrative appeal within the timeframes set forth in articles 25 to 42 of Law 29/1998, of July 13.

The integration of the museum into direct municipal management represents a significant change for the employees, who will now depend on the City Council, and for the cultural management of Puerto de la Cruz, which takes direct responsibility for the conservation of its archaeological heritage.
