Provincial Council modifies expropriations for the T-4233 road in Bonastre and Albinyana

The Plenary of the Diputació de Tarragona has approved the modification of the list of assets and rights affected by the Project for specific security and drainage works on road T-4233, from Bonastre to Albinyana. The agreement, adopted in the plenary session on October 2, 2026, is published in the Official Gazette of the Province of Tarragona on October 8, 2026, with the reference CVE 2026-09253, and opens a public information period of 20 business days for owners and interested parties.

The minutes of the Plenary record the agreement as item 17 of the session (reference CVE 2026-09231). The project is definitively approved with an execution budget for contract of 1,137,678.15 euros, and the approval entails the declaration of public utility, the necessity of occupation, and the declaration of urgent occupation of the affected assets and rights, as well as the initiation of the compulsory expropriation proceedings.

The legal framework invoked is Article 235.3 of the Revised Text of the Municipal and Local Regime Law of Catalonia, approved by Legislative Decree 2/2003, of April 28, and Article 19.2 of the Revised Text of the Roads Law, approved by Legislative Decree 2/2009, of August 25. The procedure complies with Article 52 of the Law of December 16, 1954, on compulsory expropriation and Articles 56 and following of its Regulation. The agreement also accepts the technical considerations and assessments of the City Councils of Bonastre and Albinyana, collected in the report of the Territorial Infrastructure Area.

Two affected estates in the municipality of Bonastre

The modified list, which will be published on the corporate website of the Diputació, details the affected estates in the municipality of Bonastre, both on non-developable land and in polygon 8:

• Estate 1 (plot 18): 22 m² of affection and 82 m² of temporary occupation.
• Estate 2 (plot 17): 7 m² of affection.

The holders listed are five:

Twenty business days of public information

The approved list of assets and rights is submitted for public information for 20 business days, counted from the day after the last of the following publications:

• Official Gazette of the Generalitat de Catalunya.
• Official Gazette of the Province of Tarragona.
• Notice board of the electronic headquarters of the Diputació de Tarragona.
• Provincial dissemination newspaper.
• Notice boards of the city councils of the affected municipalities.

Allegations may be filed before the Diputació de Tarragona. If the holders of the estates are unknown or the place of notification is ignored, notification will be made by announcement in the Official State Gazette, in accordance with Article 44 of Law 39/2015, of October 1.

Domain mutation and means of appeal

The agreement requests the domain mutation agreements in favor of the Provincial Council for the road affected by the project from the town councils of Bonastre and Albinyana, which have three months from the notification to present them. The effectiveness of the mutation is conditional upon the communication of the signing of the site layout act for the works.

The following may be filed against the final approval of the project:

• A contentious-administrative appeal within a maximum period of two months from publication, before the Tarragona Court of First Instance, contentious-administrative section.
• Alternatively, a request for reversal within a maximum period of one month, before the Plenary of the Provincial Council.

The remaining sections of the agreement are procedural acts and are not subject to appeal, although interested parties may submit allegations. The announcement was signed by the general secretary, Josep Maria Sabaté Vidal, on October 5, 2026.

The modification of the list of assets and rights is the preliminary step to the urgent occupation of the properties, meaning that affected owners will see the specific areas and deadlines for claiming. The schedule is tight: twenty business days to file allegations and three months to close the domain mutation of the road, with a contract execution budget of 1,137,678.15 euros for a safety and drainage work affecting two municipalities of the Baix Penedès.
