Tara solar park of 23.7 MW in Tauste dismissed

The General Directorate of Energy Policy and Mines has dismissed the application from Energía Inagotable de Tara, SL for the prior administrative authorization of the “Tara” solar photovoltaic park, with an installed capacity of 23.7 MW, in the municipality of Tauste (Zaragoza), agreeing to the archiving of file SGIISE/PFot-753. The decision, adopted by resolution on August 31, 2026, is published in the Official State Gazette (Boletín Oficial del Estado) number 226, dated September 12, 2026, section III, page 121742, with official reference BOE-A-2026-19108.

The project, requested on July 27, 2021, also included its associated evacuation infrastructure in the provinces of Zaragoza, Navarra, La Rioja, Álava, and Burgos. The dismissal is based on the expiration of the access and connection permits, which occurred on October 29, 2023, as the favorable environmental impact statement was not obtained within the deadline, in accordance with Royal Decree-Law 23/2020, of June 23.

Expiration of access and connection permits

The project obtained grid access permits through an access feasibility report (IVA) at the Jundiz 220 kV substation, owned by Red Eléctrica de España, SAU. Royal Decree-Law 23/2020 requires obtaining a favorable environmental impact statement within 31 months and prior administrative authorization within 34 months from the granting of the permits.

• Expiration of permits: October 29, 2023, due to the failure to obtain the favorable EIS within the deadline.
• Notification of expiration by Red Eléctrica de España, SAU: December 19, 2023.
• The failure to prove administrative milestones results in the automatic expiration of the permits and the execution of the financial guarantees provided.

Processing and separation of files

The file was initially processed cumulatively with the “Umiko” park (46.5 MW) under code PFot-752AC, and was subjected to public consultation and environmental impact assessment. The General Directorate of Environmental Quality and Evaluation issued the environmental impact statement on November 24, 2023.

• June 5, 2025: agreement to separate the files, moving the Tara project to file PFot-753.
• June 13, 2025: hearing process regarding the proposed dismissal, with a fifteen-business-day deadline without a response from the promoter.
• June 29, 2026: Energía Inagotable de Tara, SL requests the archiving of the file.

Effects and appeals

The resolution, signed by Director General Manuel García Hernández, does not exhaust administrative remedies. An administrative appeal (recurso de alzada) may be filed before the holder of the Secretary of State for Energy within one month of its publication in the BOE.

The dismissal nullifies the authorization of a renewable generation plant in the Ebro corridor, in a context where the photovoltaic deployment in Aragón and neighboring communities depends on the timely accreditation of administrative access and connection milestones. The case illustrates the strict application of the deadlines of Royal Decree-Law 23/2020, which penalizes the expiration of permits with the execution of the deposited financial guarantees, unless the lack of a favorable EIA is not attributable to the developer.
