Denmark moves to protect 4.2 hectares at Hestkøbgård near Birkerød

A revised proposal to protect around 4.2 hectares of land at Hestkøbgård in Rudersdal Kommune has been formally announced in Statstidende, triggering an immediate statutory ban on works that conflict with the plan. Under section 37, subsection 2 of the Danish Nature Protection Act (naturbeskyttelsesloven), nothing contrary to the proposal may from now on be carried out in the area, and violations may be punished with a fine. The Fredningsnævnet for København has called a public meeting on the case for Monday, 30 November 2026, from 12:00 to 15:00, to be followed by an on-site inspection.

The announcement, carried in Statstidende on 27 October 2026 in the miscellaneous announcements section under the heading “Naturfredning – Sagens rejsning” (nature protection – initiation of the case), records that Rudersdal Kommune raised the protection proposal on 19 December 2025. The text published now is the revised proposal, which covers approximately 4.2 hectares and comprises the cadastral parcel matr.nr. 1 bg Hestkøb, Bistrup. The notice was signed in Odense on 23 October 2026 by the Styrelsen for Grøn Arealomlægning og Vandmiljø (Danish Agency for Green Land Conversion and Water Environment), which is responsible for publishing it.

Four stated purposes of the protection

The notice lists the objectives the protection order is intended to secure:

  • continued recreational use of the area for allotment gardens and scout activities;
  • that construction and installations are established with respect for the area’s green character;
  • that the area is secured as a green connecting link between the path along Duemosevej, the residential area to the east, and the paths in the forest, the park and the golf course grounds at Hestkøbgård;
  • that nature management of the area’s contiguous planting is carried out with the aim of strengthening biodiversity.

The stated aim of preserving allotment and scout use, together with the corridor wording, frames the site as a recreational green wedge rather than a development reserve.

How to see the proposal and where to object

The proposal itself is not reproduced in the gazette, but the notice sets out how interested parties can obtain it and where the case will be heard:

  • the proposal can be requested in writing, preferably digitally via borger.dk, from Rudersdal Kommune;
  • it can also be consulted on the Danish nature-protection appeal boards’ website at fredningsnaevn.dk under the announcements for 2026;
  • the public meeting takes place on Monday, 30 November 2026, 12:00–15:00, at 2. Birkerøds Hytte, Hestkøb Vænge 22B, 3460 Birkerød, with a subsequent inspection of the area;
  • at the meeting, the proposal and the course of the case will be explained;
  • enquiries go to the Fredningsnævnet for København, c/o Retten i Lyngby, Lyngby Hovedgade 96, 2800 Kongens Lyngby, telephone 21138531, quoting case number FN-KBH-069-2025F.

A freeze on works from the day of announcement

The legal consequence of the publication is immediate. Because the protection case has now been initiated, section 37, subsection 2 of the naturbeskyttelsesloven applies to the covered land, so any work, construction or intervention that would conflict with the purposes set out in the proposal is prohibited while the case is pending. The notice states explicitly that infringement may result in a fine, which places the risk on landowners and users who act before the Fredningsnævnet has ruled.

The practical effect is that the roughly 4.2 hectares at Hestkøbgård are now under a standstill regime that lasts until the protection order is finally determined or the case is otherwise concluded. For the users named in the proposal — allotment holders and scout groups — the plan also signals continuity, since their activities are written into the objectives as the very purpose of the protection.

For local landowners, tenants and neighbours, the material date is 30 November 2026: the meeting at Birkerøds Hytte is the occasion at which the proposal and its consequences for matr.nr. 1 bg Hestkøb, Bistrup will be presented and the site itself inspected. Anyone with an interest in the roughly 4.2 hectares should read the revised proposal before that date and raise their points then.
