Denmark moves building and housing register law to energy ministry
Por FactBox Admin

Responsibility for Denmark’s Building and Housing Register Act has passed from the Skatte- og Vækstministeriet to the Klima-, Energi- og Forsyningsministeriet with effect from 1 November 2026. The transfer was decided by royal resolution of 27 October 2026 on the recommendation of the prime minister. It is announced in Statstidende of 3 November 2026 under reference S01112026-4.
The notice is carried in the gazette’s ministerial section, “Diverse · Ministrene”, the standing channel through which changes in the distribution of portfolios between government departments are published. The instrument is a royal resolution issued after the prime minister’s recommendation, which is the established procedure for moving a subject area from one ministry to another. The resolution does not amend the legislation itself: what changes is the ressortansvar, the portfolio responsibility for the act on the building and housing register, known in Danish as BBR-loven (lov om bygnings- og boligregistrering).
A decision dated 27 October, in force 1 November
The timetable set out in the notice runs ahead of its publication. The resolution is dated 27 October 2026, the transfer took effect on 1 November 2026, and the announcement appeared in Statstidende two days later, on 3 November 2026. The three dates therefore straddle the change: the decision was taken in October, the ministries swapped responsibility at the start of November, and the public record of the switch followed on the third.
Two ministries, one act
The notice names both sides of the transfer and its legal basis without further qualification:
- Outgoing ministry: Skatte- og Vækstministeriet
- Incoming ministry: Klima-, Energi- og Forsyningsministeriet
- Legal basis: royal resolution of 27 October 2026, on the prime minister’s recommendation
- Effective date: 1 November 2026
- Published: Statstidende, 3 November 2026, reference S01112026-4
The register behind the notices
The building and housing register is the reference source that Danish property notices are written against, and its fields appear verbatim in forced-auction announcements published in the same gazette. Those notices transcribe register data rather than surveying the property, which makes the register’s accuracy a direct matter for buyers, creditors and estate agents reading them.
- Plot area, dwelling area and total building area in square metres
- Roof storey and utilised roof storey
- Heating form and the location of the boiler within the building
- Structures such as garden rooms, outbuildings and carports, where these are recorded
- Register owner notices (BBR-ejermeddelelse) cited as documentary evidence in forced sales
Where the notice and the physical property diverge, the gazette’s announcements state the discrepancy explicitly, for example a greenhouse absent from the register or a heating form that does not match the recorded entry.
Consequences for municipalities and data users
The practical effect is a change of addressee rather than of substance. Municipalities, utility companies and commercial users of property data will in future take the rules, guidance and case-handling for the act to the Klima-, Energi- og Forsyningsministeriet, which now answers for it in the Folketing and in public administration, while the Skatte- og Vækstministeriet ceases to hold that role from 1 November 2026.
For readers of the gazette the significance is procedural but immediate. The register underpins valuation, taxation follow-up, energy planning and the sale of property, and the ministry that now owns the act sets the terms on which buildings, areas and heating installations are recorded. Anyone relying on register data — and anyone contesting an entry — has a different authority to deal with from the start of November, even though the wording of the act itself is untouched by the resolution of 27 October.
