The Provincial Council of Ourense has declared the urgent need for the occupation of assets and rights affected by the improvement works on road OU-0304 between A Armada and Astariz, phase 3, in the municipality of Castrelo de Miño. The agreement was adopted by the provincial Governing Board in the session of October 26, 2026, and published in the Official Gazette of the Province of Ourense on October 29, 2026, section I, under reference R. 2.595. The material occupation of the properties has been set for November 6.

The file is processed under Article 21 of the Compulsory Expropriation Law of December 16, 1954, by virtue of the competence delegated by the Plenary of the Provincial Corporation (published in BOP No. 184, August 11, 2023). In the same session, the Governing Board resolved the allegations submitted by the interested parties, approved the technical project for the works, and definitively declared the need for occupation.

The announcement was signed in Ourense on October 27, 2026, by the delegated deputy for Provincial Administration, Transparency, Emergencies, and Cross-Border Cooperation, Plácido Álvarez Dobaño, by delegation decree of July 31, 2023. The publication serves as notification for unknown interested parties or those with an unknown address, in accordance with Law 39/2015 on the common administrative procedure.

Occupation records on November 6

The drawing up of occupation records will take place at the town hall of Castrelo de Miño on Friday, November 6, 2026, in two sessions:

  • 11:00 hours: plots 12 and 27.
  • 11:15 hours: plots 32 and 35.

The appointment affects the four cited direct owners as well as the holders who share plot 1000, which makes the day a procedure with a massive presence of neighbors from Astariz.

Appeals and information

  • Optional appeal for reversal before the Governing Board of the Deputación, within a period of one month.
  • Contentious-administrative appeal before the Contentious section of the Court of First Instance of Ourense, within a period of two months.
  • The two appeals are incompatible with each other and the deadlines are counted from the day following the publication of the announcement.
  • Information at the Expropriations Office, rúa Progreso nº 32, 32003 Ourense (telephone 988 317535; expropiaciones@depourense.gal), on Mondays, Tuesdays, and Fridays.

The declaration closes the administrative phase prior to occupation and opens a very short calendar for those affected: whoever does not attend the drawing up of records or does not present allegations within the indicated deadlines will see their capacity to discuss the valuation of the land limited, which will be resolved subsequently in the fair price phase.
