The Autonomous City of Ceuta has declared the call for the provision of two Physician positions corresponding to the 2022 Public Employment Offer void, after no applicants appeared for the first exercise of the competitive examination phase. The decision was adopted by the Councilor for Presidency and Governance, Alberto Ramón Gaitán Rodríguez, via a decree dated October 16, 2026, published in the Official Gazette of the City of Ceuta number 6,663, of October 23, 2026, on page 3,678 (reference 703).

A call that remained without candidates

The decree recalls that the rules of the process were approved by another decree from the same councilor, dated October 3, 2023, and were published in the Official Gazette of the City of Ceuta number 64, of October 6, 2023, with subsequent insertion in the Official State Gazette number 38, of February 13, 2024.

The announced positions had the following characteristics:

  • Two Physician positions within the City’s civil servant staff.
  • Special Administration scale, Technical sub-scale.
  • Group A, Subgroup A1.
  • Selective system of competition-examination in the open category.
  • Linked to the Public Employment Offer for the 2022 fiscal year.

Through an announcement on May 21, 2025, applicants were summoned to perform the first exercise of the competitive examination phase. The Qualifying Tribunal, in minutes dated May 28, 2025, recorded that, once the single call was initiated, none of the summoned applicants appeared.

The resolution is based on Base 11 of the call, which attributes the resolution of the process to the competent body in personnel matters and requires its mandatory publication in the Official Gazette of the City of Ceuta. The councilor acts using the powers conferred by the Decree of the Presidency of the City of Ceuta of June 23, 2023, published in the Extraordinary Official Gazette of the City of Ceuta number 42, of June 23, 2023.

The decree is structured into three sections:

  • First: formal declaration that the call for the two Physician positions is void.
  • Second: publication of the resolution in the Official Gazette of the City of Ceuta.
  • Third: appeals regime against the administrative act.

Open avenues for appeal

Against the decree, which exhausts the administrative route, interested parties may file an optional appeal for reversal before the same body that issued it within a period of one month from its notification or publication, in accordance with articles 123 and 124 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

Alternatively, a contentious-administrative appeal may be filed before the Contentious-Administrative Courts of Ceuta within a period of two months, in accordance with articles 8.1 and 46 of Law 29/1998, of July 13, regulating the Contentious-Administrative Jurisdiction. If the option for reconsideration is chosen, the contentious-administrative appeal may not be filed until the former is expressly resolved or its presumed dismissal occurs.

A process that closes three years later

The declaration of vacancy closes a procedure opened in October 2023, whose opposition phase was convened in May 2025, without the first exercise ever being held due to a total absence of candidates. The same bulletin includes other personnel resolutions from the counselor of Presidency and Governance, including the provisional list of admitted candidates for one Telecommunications Engineer position via internal promotion, with a single application submitted.

The result leaves two specialist positions unfilled in the City’s civil service staff and necessitates restarting, if applicable, the administrative process to staff them, with the consequent delay in the coverage of healthcare personnel and in the execution of the 2022 employment offer.
