Curator seeks five-year bankruptcy ban against respondent with Dubai address

The curator of Tamilecom ApS has asked Retten i Svendborg to impose a five-year bankruptcy disqualification on Thageeshan Theiventhiramoorthy under § 157 of the Danish Bankruptcy Act. The request, registered as case BS-30768/2026-SVE, was published in Statstidende on 23 October 2026 and is being served by public notice because the respondent’s current whereabouts are unknown. He has four weeks from publication to file a defence.

The application comes from advokat Boris K. Frederiksen, curator of the estate of Tamilecom ApS under konkurs (CVR no. 42815748). The court papers give the respondent’s last known address as Burj Royale 2902, 0000 Dubai, United Arab Emirates — an address on record that has not made personal service possible.

Bankruptcy disqualification is the Danish mechanism that bars a person from managing a business after a bankruptcy. Under the rules as set out in Statstidende notices, a disqualification may run for up to five years and means the person may not take part in the management of an enterprise without personal and unlimited liability for its obligations — in practice, no management posts in limited companies. A disqualification is entered in Erhvervsstyrelsen’s register of persons subject to bankruptcy disqualification, and register data may be passed to the bankruptcy court, the police and the prosecution service.

Two parallel cases against the same respondent

On the same day, Statstidende carried a second, near-identical notice concerning Marketizer ApS under konkurs (CVR no. 42819220), again with Boris K. Frederiksen acting as curator. That request seeks the same five-year disqualification against Thageeshan Theiventhiramoorthy, on the same Dubai address, and is registered as case BS-30764/2026-SVE at Retten i Svendborg.

  • Estate: Tamilecom ApS under konkurs, CVR 42815748, case BS-30768/2026-SVE.
  • Estate: Marketizer ApS under konkurs, CVR 42819220, case BS-30764/2026-SVE.
  • Curator in both cases: advokat Boris K. Frederiksen.
  • Respondent in both cases: Thageeshan Theiventhiramoorthy, last known address Burj Royale 2902, 0000 Dubai.
  • Relief sought in both cases: disqualification for 5 years under § 157 of the Bankruptcy Act.

Four-week deadline and judgment by default

The court has called on the respondent to submit a statement of defence on minretssag.dk within four weeks of the notice’s publication in Statstidende. If no defence is filed within that period, the court may give judgment in favour of the estate’s claim as set out in the pleadings. The respondent may inspect the pleadings and the case documents on minretssag.dk or obtain them from the court.

Public service because the address is untraceable

Both notices state that the disqualification request is served by public notice because the respondent’s present place of residence is unknown. The notices are signed by Klara Kamilla B. Mortensen, dommerfuldmægtig at Retten i Svendborg.

For creditors of the two estates, the publications are the formal opening of proceedings that could remove the respondent from corporate management for five years. For anyone dealing with him, a granted disqualification would appear in Erhvervsstyrelsen’s public register and would bar him from management posts without personal liability. No ban is in force yet: the court decides on the estates’ claims, and the four-week window is the stated opportunity to contest them.
