Cultura incoa com a monument històric la Casa Vilaró de Barcelona

The Department of Culture of the Generalitat de Catalunya has initiated the proceedings to declare the Casa Vilaró in Barcelona as a Cultural Asset of National Interest, in the category of Historic Monument, and to delimit its protection environment. The decision is contained in Resolution CLT/3658/2026, dated October 7, signed by the Minister Sònia Hernández Almodóvar, and is published in the Official Gazette of the Generalitat de Catalunya (DOGC) no. 9775, dated October 19, 2026, with the reference CVE-DOGC-A-26286063-2026. The initiation entails the suspension of the processing of licenses for subdivision, construction, or demolition in the affected area.

The resolution, included in the Other provisions section of the bulletin, is immediately preceded by the favorable report issued by the Directorate General of Cultural Heritage on September 21, 2026. The legal framework invoked is Law 9/1993, of September 30, on Catalan cultural heritage, which regulates both the initiation of declaration proceedings and the resulting protection effects while a final resolution is pending.

A protection environment mapped on a plan

Agreement number 1 of the resolution is not limited to the declaration of the monument: it also orders the delimitation of its protection environment. This environment is mapped on the plan included in the administrative file, meaning that the protection applies not only to the building but also to the surrounding area.

The delimitation is relevant because it is precisely this area that is affected by the suspension of urban planning licenses established by the same resolution.

Suspension of licenses and already authorized works

In accordance with article 9.3 of Law 9/1993, the initiation of the proceedings has immediate effects on planning and licenses in the affected area:

  • Suspension of the processing of licenses for subdivision, construction, or demolition.
  • Suspension of the effects of licenses already granted.
  • Possibility for the Department of Culture to authorize works that are clearly not detrimental to the cultural values of the asset.
  • The prior nature of this authorization with respect to the municipal license, except in the case of licenses granted before the publication of the resolution.

The resolution orders that these effects be notified to the interested parties and communicated to the Barcelona City Council, which is the competent administration for granting the affected licenses.

One month to examine the file and present allegations

Point 3 of the resolution opens a public information period provided for in article 8.2 of Law 9/1993. The deadline is one month starting from the publication in the DOGC, that is, from October 19, 2026, and during this period, any person may examine the file and make any allegations they deem appropriate.

The enabled consultation points are:

  • The Electronic Registry of the Generalitat de Catalunya (tauler.seu.e.cat).
  • In person, by appointment, at the headquarters of the Directorate General of Cultural Heritage of the Department of Culture (Palau Moja, carrer de la Portaferrissa, 1, 08002 Barcelona; sdgpatrimoni.cultura@gencat.cat).
  • The headquarters of the Territorial Services of the Department of Culture in Barcelona (plaça Salvador Seguí, 1-9, 08001 Barcelona; stbarcelona.cultura@gencat.cat).

Preventive annotation and transfer to the State

Finally, point 4 mandates communicating the resolution to the Registry of Cultural Assets of National Interest for its preventive annotation and transferring it to the General Registry of Assets of Cultural Interest of the State Administration. The preventive annotation is what provides registry coverage for the protection while the file is not yet resolved.

The initiation does not equate to the definitive declaration: it is the step that opens the procedure, establishes the protected environment, and activates precautionary measures. The final declaration will correspond to the resolution issued once the period for allegations has closed.

For the neighbors and owners of the area, the practical effect is immediate: any demolition project or work in the surroundings of Casa Vilaró is frozen or subject to prior authorization from the Department of Culture, and licenses already granted lose their effects for the duration of the processing.
