Cruïlles obre un mes d'al·legacions a la modificació del traçat d'un vial

The City Council of Cruïlles, Monells i Sant Sadurní de l’Heura has initially approved a specific modification of its urban planning to change the layout of an existing road on non-developable land. The agreement was reached by the Plenary in an ordinary session on September 24, 2026, and is published in the Official Gazette of the Province of Girona no. 201, dated October 19, 2026, with the official reference BOP-2026_0_201_8783. The same announcement opens a one-month period of public information and suspends the granting of licenses in the affected areas.

The published text contains five agreements from the Plenary. The first initially approves the specific modification of the Planning —which the file identifies as the PGOU— “for the modification of the layout of an existing road on non-developable land, in the terms contained in the file.” The announcement is electronically signed by the mayor, Daniel Encinas Granados, on October 5, 2026, and is issued by the Provincial Council of Girona.

One month to examine the file and submit allegations

The specific modification and the corresponding file are submitted for public information for one month. The announcement is disseminated through four simultaneous channels:

  • the Official Gazette of the Province of Girona;
  • one of the most widely circulated newspapers in the municipality;
  • the Corporation’s notice board;
  • the municipal website, www.cmss.cat.

During this period, any person may examine the documentation and formulate the allegations and observations they deem appropriate. In-person consultation takes place at the municipal offices of the Cruïlles City Council on Mondays from 10 a.m. to 1 p.m. and Thursdays from 5 p.m. to 8 p.m., and also electronically on the council’s website.

Suspension of licenses in affected areas

The fourth agreement is the one with the most direct impact on owners and developers. The Plenary suspends the granting of approvals and licenses in the areas where the new determinations modify the current urban regime. The suspension covers:

  • land subdivision licenses;
  • licenses for construction, renovation, rehabilitation, or demolition of buildings;
  • licenses for the installation or expansion of specific activities or uses;
  • other related municipal authorizations established in sectoral legislation.

The measure is not general to the entire municipality, but is limited to the areas where the new road layout alters the applicable urban conditions.

Sectoral reports and notification to interested parties

The third agreement provides for requesting reports from the bodies affected by reason of their sectoral competencies, a step prior to final approval. The fifth requires the notification of the agreement to all persons interested in the file.

The announcement warns that the initial approval agreement cannot be challenged, as it is an unqualified administrative procedural act. This limits the immediate route of appeal and shifts any discrepancy to the channel of allegations during the month of public information.

The news arrives at a time of urban planning and public works activity in the municipality: the same council initially approved on August 27, 2026, by agreement of the Local Government Board, the project for the substantial improvement of rural roads in the district, with a contract execution budget of 134,599.45 euros, published in the Official Gazette of the Province of Girona no. 182, dated September 22, 2026.

For residents and owners of non-urbanizable land, the calendar is now the determining factor: the month of public information is the only window to influence the final layout of the road before the Plenary resolves the allegations and definitively approves the modification. Meanwhile, anyone wishing to subdivide, build, renovate, or open a business in the affected areas will find their license suspended.
