Corte Suprema reincorpora a dos notarios tras cumplir sus suspensiones

The Supreme Court of Justice declared the suspensions imposed on two notaries in the exercise of the public function of the notary ended and ordered their reinstatement to the permanent roster of certifying officers. The decision is contained in agreements 1925-D and 1926-D, issued by the General Secretariat of the court on September 23, 2026, and published in the Official Gazette Volume No. 453 on October 6, 2026, in the second publication section of the Supreme Court of Justice.

The agreements are issued by virtue of the delegation conferred by the Plenary of the Supreme Court of Justice through Agreement 7-P of October 17, 2019, and based on articles 24 and 43 of the Administrative Procedures Law, article 70 obligation 13a of the Judicial Organic Law, articles 14 and 182 attribution 12a of the Constitution of the Republic, and article 13 of the Notary Law.

Both pronouncements execute the administrative acts derived from sanctions issued in disciplinary proceedings. In both cases, the Plenary resolved on September 8, 2026, to declare the suspension period concluded and to reinstate the professionals, effective as of September 23 of the current year. The documents appear in the bulletin summary under the heading “Agreements Nos. 1925-D and 1926-D.- Suspensions imposed in the exercise of the public function of the notary are declared ended,” on page 11.

The two reinstated certifying officers

  • Gerber Ulises Méndez Molina, graduate, suspended from the exercise of the public function of the notary since February 15, 2024, sanction applied through agreement number 482-D of March 7, 2024. His disciplinary file is D-889-23 (D-004-MG-23) and his reinstatement was registered under number F50601.
  • Wendy Odily Hernández de Orellana, graduate, suspended since September 21, 2023, by agreement number 1048-D of September 27, 2023. Her file is D-1001-22 (D-002-HW-22) and the reinstatement was registered under number F50607.

In both cases, the resolution provides to “include the name” of the professional in the permanent roster of notaries, which restores their authorization for the exercise of public faith.

Communication to courts and registries

The agreements order the issuance of an official letter informing of the decision to all courts and public registries in the country, in addition to its publication in the Official Gazette. The instruction seeks to ensure that judicial and registry offices update their controls on the authorization of certifying officers and can admit without objection the instruments they authorize as of the effective date.

The documents are signed by Julia del Cid, Esq., General Secretary of the Supreme Court of Justice, and are dated San Salvador, September 23, 2026.

The reinstatement has an immediate effect on the validity of notarial acts: deeds, powers of attorney, certified copies, and proceedings granted before these two public officers are once again fully backed as of September 23, 2026. For notaries, lawyers, courts, and real estate and mortgage registries, agreements 1925-D and 1926-D are the mandatory reference when verifying the status of both professionals on the permanent notary roll.
