Copenhagen maritime court lifts Cozy Ketchup bankruptcy decree eight days later

The bankruptcy division of Sø- og Handelsretten (Skifteretten) revoked on 15 October 2026 the bankruptcy decree it had issued on 7 October 2026 against P/S COZY KETCHUP, CVR 28154224, Hovedvagtsgade 8, 4, 1103 København K. The court acted under konkurslovens § 21, stk. 3, and the revocation was published in Statstidende on 20 October 2026 in the bankruptcy notices section, under official reference S16102026-38.

The order closes a case that had spent only eight days in bankruptcy proceedings, docketed as K 2217/26-F. The original decree had been announced in Statstidende on 9 October 2026 (reference S07102026-275), where the court recorded that it had taken the partnership under bankruptcy proceedings on the basis of a petition received on 7 October 2026 from the company’s liquidator. Advokat Peter Wedel Ranch Krarup, Amaliegade 10, 1256 København K, was appointed trustee in the same announcement.

A decree withdrawn under paragraph 21(3)

The revocation notice is short and formal. It states that Sø- og Handelsretten’s bankruptcy division, pursuant to konkurslovens § 21, stk. 3, on 15 October 2026 revoked the decree of 7 October 2026 over P/S COZY KETCHUP, and it repeats the company’s registration number, its registered address in central Copenhagen and the case number K 2217/26-F. The notice is dated at Sø- og Handelsretten, Skifteretten, on 16 October 2026.

The published text does not give the grounds for the reversal, nor does it record whether the trustee’s appointment lapsed at the same moment. What it establishes is the operative fact: the decree no longer stands, and the partnership is not under bankruptcy proceedings.

Eight days between decree and reversal

The two announcements, read together, set out a compressed timeline:

  • 7 October 2026: the court receives the liquidator’s petition and issues the bankruptcy decree.
  • 9 October 2026: the decree is announced in Statstidende, with the trustee’s name and address.
  • 15 October 2026: Skifteretten revokes the decree under konkurslovens § 21, stk. 3.
  • 16 October 2026: the revocation order is dated.
  • 20 October 2026: the revocation is announced in Statstidende as S16102026-38.

The decree announcement had also set the ordinary machinery in motion. It stated that no meeting had been convened to elect a trustee or appoint a creditors’ committee, and it gave creditors two windows to act:

  • Three weeks from the announcement to request in writing that such a meeting be convened before Sø- og Handelsretten’s bankruptcy division at Amaliegade 35, 2. sal, 1256 København K.
  • Four weeks from the announcement to file claims against the estate with the trustee, valued as at the bankruptcy date and supported by documentation.

Both deadlines were still running when the decree was revoked, and the revocation notice does not address them.

What the reversal changes for creditors and counterparties

For the company, the effect is that the bankruptcy estate described in the 9 October announcement no longer exists as a proceeding: the trustee appointed on 7 October, Peter Wedel Ranch Krarup, is not mentioned in the revocation notice, and no distribution or claims process is announced in its place. For creditors, the practical consequence is that the four-week filing window opened by the decree has been overtaken by an order issued eight days later.

The case is also a reminder of how quickly the bankruptcy register can move. P/S COZY KETCHUP went from decree to revocation inside a single working week and a half, with the reversal appearing in the official gazette only four days after the court signed it. Operators tracking the company should rely on the 20 October notice, not the 9 October one, as the current statement of its status.
