Convocan las actas previas de expropiación de la fotovoltaica Santa María en Padul

The Territorial Delegation of Economy, Finance, European Funds and Industry, Energy and Mines in Granada has called for the drawing up of the records prior to the occupation of the assets and rights affected by the “SANTA MARÍA Photovoltaic Plant, Evacuation Line and Electrical Substation” in the municipality of Padul. The appearances have been scheduled for October 14, 2026, at the Padul Town Hall, between 09:30 and 14:00 hours. The announcement, dated July 22, 2026, is published in the Official Gazette of the Province of Granada No. 191, of October 2, 2026, with reference BOP-GRA-2026-191002 (file E-4664).

The call stems from the Resolution of February 9, 2026, of the aforementioned Territorial Delegation, which specifically declared the project to be of public utility for the purposes of compulsory expropriation, temporary occupation, and the imposition of rights of way. The promoter is Alcance Fotovoltaico, S.L., with NIF B09605361, which acquires the status of beneficiary of the expropriation.

The declaration was published in the Official State Gazette on February 14, 2026, in the Official Gazette of the Junta de Andalucía on February 23, 2026, and in the Official Gazette of the Province of Granada on February 25, 2026. The procedure is supported by Article 148.2 of Royal Decree 1955/2000, of December 1, and Article 56 of Law 24/2013, of December 26, of the Electricity Sector; the declaration implies the urgent occupation provided for in Article 52 of the Compulsory Expropriation Law of December 16, 1954.

Documentation and rights of the interested parties

Those summoned must appear personally or be represented by a duly authorized person, providing documents proving ownership and the most recent receipt of the Real Estate Tax (IBI). They may be accompanied, at their own expense, by an expert and a notary if they deem it appropriate.

Until the drawing up of the payment and occupation records, interested parties may submit written allegations to the Delegation, limited to correcting possible errors in the description of the properties, and examine the file containing the characteristics of the plots and the details of the assets subject to expropriation. Those who consider themselves to have a superior right may appear on the designated day and time to file their claim.

Failure to appear will not prevent the drafting of the appropriate records. If the interested party does not receive the fair price, it will be deposited in the General Deposit Fund (Caja General de Depósitos) of the Territorial Delegation.

Notification and Publicity

The announcement will be notified to the Padul City Council and to the interested persons individually, by electronic means or, failing that, on paper, and will be published in the BOE, the BOJA, the BOP, the City Council’s notice board, and two provincial newspapers. These publications also serve as notification to unknown interested parties or those whose address is unknown, in accordance with Article 44 of Law 39/2015, of October 1.

The announcement was signed in Granada on July 22, 2026, by the territorial delegate, Gumersindo Fernández Casas.

The call opens the expropriation phase of an energy project affecting a dozen estates in the municipality of Padul and concentrates the appearances of the owners on a single day, October 14. From that moment, the occupation of the land is enabled via the urgent procedure, with the fair price as the main point of negotiation for those affected.
