Constantí cancels the call for First Officer and will refund the fees

The Constantí City Council has cancelled the call for the selection process to fill one position of First-Class Official, group C, subgroup C2, for permanent contractual staff, and has agreed to fully refund the examination fee to all applicants. The decision, adopted by Mayoral Decree no. 2026-1401, dated September 4, 2026, is published in the Official Gazette of the Province of Tarragona on September 8, 2026 (reference CVE 2026-08377, pp. 1-2).

The measure responds to the subsequent material impossibility of continuing the process, derived from the organizational reconfiguration of the Municipal Brigade and the associated workstations. The cancellation nullifies the rules approved by Mayoral Decree no. 2025-1538, dated October 1, 2025, which had regulated the call corresponding to the 2024 Public Employment Offer.

Reasons for the cancellation

The city council argues that the reorganization of the Municipal Brigade directly affects the characteristics, functions, and organizational fit of the First-Class Official position that was the subject of the call. For this reason, the material impossibility of continuing the selection process, which was to be resolved through a competitive examination with the creation of a job bank, is declared.

The agreement provides that, once the new configuration of the Municipal Brigade and the associated workstations has been defined, the corresponding procedures shall be initiated, if applicable, to cover the resulting staffing needs.

Refund of examination fees

The decree recognizes the right of all applicants who have paid the fee of 25.00 euros for examination rights to obtain a full refund. The refund will be initiated ex officio, without the need for the interested parties to submit an express request:

• The Municipal Treasury will carry out the checks and necessary actions to execute the reimbursements.
• When the essential bank details are not available, these will be requested individually from the interested person, without the request altering the ex officio nature of the refund.

Publicity and appeals

The resolution will be published in the Official Gazette of the Province of Tarragona, the Official Gazette of the Generalitat de Catalunya, the Official State Gazette, the Corporation’s notice board, and the municipal electronic office, in order to give the cancellation the same publicity as the original call.

The resolution, signed by Mayor Oscar Sánchez Ibarra, concludes the administrative process. An administrative appeal may be filed against it before the Administrative Litigation Section of the High Court of Justice of Tarragona within two months, or, optionally, a request for reversal may be filed before the mayor-president of the Constantí City Council within one month, counting from the day following its publication.

The decision directly affects the individuals who had formalized their registration and paid the fee for a position that, for the time being, remains unfilled. For the applicants, the automatic refund of the fees represents an administrative relief, while the municipality keeps the door open for a new call for applications once the restructuring of the Municipal Brigade is defined.
