Four years in prison sentenced for possession of narcotics

The Federal Oral Criminal Court of Corrientes sentenced Alejandro Rodolfo Benítez, alias “El loco Ale”, to a term of four (4) years in prison as a criminally responsible co-perpetrator of the crime of possession of narcotics for commercial purposes, aggravated by the involvement of three or more people. The resolution was published in the Official Gazette of the Argentine Republic on August 31, 2026, in the second section.

The sentence was issued within the framework of the case titled “Zapata, Juan Carlos (father) and others re: violation of Law 23.737”, case file No. 1709/2022/TO1, by means of Sentence No. 47 dated June 4, 2026. The publication was ordered by disposition of the execution judge, Dr. Fermín Amado Ceroleni, for a term of five (5) days.

The court considered Benítez’s responsibility proven in the possession of narcotics for commercial purposes, a figure provided for and punished by articles 5 subsection c) and 11 subsection c) of Law 23.737, in concurrence with article 45 of the Penal Code. The applied aggravating factor corresponds to the involvement of three or more people in the act.

The penalty and its conditions

In addition to the custodial sentence, the ruling provides for:

  • Forfeiture of the assets seized in the case.
  • A fine of the legal minimum, which must be paid within thirty (30) days of the resolution becoming final.
  • Legal accessories and costs of the process.

Data of the convicted person

Alejandro Rodolfo Benítez, Argentine, DNI No. 30.000.686, single, by profession a bricklayer, illiterate, with an education level up to second grade of primary school, residing at José María Cialzeta No. 524 in the city of Goya (Corrientes), born on January 22, 1983, son of Rodolfo Eulogio Benítez and Francisca Irati Ojeda.

Subsequent procedure

The sentence orders the registration of the resolution, the sending of the corresponding communications and, once final, the Secretariat shall perform the calculation of the sentence, fixing the date of its expiration in accordance with article 493 of the National Code of Criminal Procedure, and remit the procedural documents to the execution judge. The ruling bears the signature of the chamber judge Dr. Fermín Amado Ceroleni, with the intervention of the court secretary Dr. José Alfredo Rach and the penal execution secretary Dr. Sebastián Ávila.

The publication of this sentence in the official gazette reinforces the transparency of the judicial system regarding drug trafficking and allows the community to know the outcome of a case of public interest, within a context of criminal policy oriented toward the prosecution of the illegal trade of narcotics.
