Commission clears 53.16 million euros of French aid for Lyon heating

The European Commission has authorised France to grant EUR 53 156 000 in additional State aid to extend the district heating network of the Métropole de Lyon and to create a biomass heating plant. The clearance decision was adopted on 11 May 2026 and published on 26 October 2026 in the Official Journal of the European Union under aid number SA.115890 and document reference C/2026/5541. The Commission raised no objections under Articles 107 and 108 of the Treaty on the Functioning of the European Union.

The notice appears in the C series of the Official Journal, in the recurring list of State aid cases authorised by the Commission, and carries the standard mention that it is a text with EEA relevance. It is a one-page summary of a decision whose full text, stripped of confidential information, is held by the Commission’s competition services.

The measure is registered as an “Ad Hoc Case” — aid awarded outside a Commission-approved aid scheme — and takes the form of a direct grant. The beneficiary named in the notice is SAS ELM. The stated objectives are renewable energy and energy efficiency, and the aid is booked against the economic sector described as “steam and air conditioning supply”. The region concerned is Rhône-Alpes.

The figures in the notice

  • Overall budget: EUR 53 156 000.
  • Aid number: SA.115890.
  • Date of adoption of the decision: 11 May 2026.
  • Member State: France; region: Rhône-Alpes.
  • Type of measure: ad hoc case.
  • Form of aid: direct grant.
  • Objectives: renewable energy and energy efficiency.
  • Economic sector: steam and air conditioning supply.

ADEME as granting authority

The body named as responsible for granting the aid is ADEME, with its registered address at 20 avenue du Grésillé, BP 90406, 49004 Angers Cedex 01.

The legal basis cited is the French Code de l’environnement, articles L.131-3 and L.131-6 and R.131-2 and R.131-3, which set out the agency’s missions, together with ADEME’s general rules on the award of aid. Those rules were adopted by its board, the Conseil d’administration, by deliberation no. 14-3-7 of 23 October 2014 and have since been amended.

What the summary leaves open

The published notice is deliberately short. Two fields — aid intensity and duration — are left blank, and no information is given on eligible costs, the maximum aid per project or the timetable for the works on the Lyon network.

The Commission states only that the authentic text of the decision, from which all confidential information has been removed, can be consulted through its competition case search portal, where the case is filed under the State aid instrument.

Why it matters

For households and operators connected to the Lyon network, the decision clears the EU State aid hurdle that any national subsidy of this size must pass before it can be paid. The Commission accepts that the money, channelled through ADEME, pursues renewable energy and energy efficiency objectives, which is the legal condition allowing France to support the extension of the network and the new biomass boiler without breaching the single market rules. The case also shows how the EU executive scrutinises subsidies one file at a time: even a single ad hoc grant must be notified and cleared before disbursement.
