Comfica, sanctioned with 49,181 euros for agreements in fraud of law

The Official Gazette of Galicia publishes in its edition of this Thursday, September 24, 2026, the final sanction of 49,181 euros imposed on the company Comfica Soluciones Integrales, S.A. for a very serious infringement regarding occupational risk prevention. The publication is ordered by the General Secretariat of Employment and Labor Relations, of the Ministry of Employment, Trade and Emigration, through the Resolution of September 10, 2026, referring to file 2023/0017-0. The sanction became final through judicial proceedings on July 31, 2026.

The obligation to publicize these sanctions derives from article 40.2 of the Legislative Royal Decree 5/2000, of August 4, which approves the revised text of the Law on infringements and sanctions in the social order, which establishes that sanctions for very serious infringements, once final, shall be made public in the manner determined by regulation. The development of this provision corresponds to Royal Decree 597/2007, of May 4, while the Order of the Ministry of Labor of July 30, 2008, published in DOG no. 152 of August 7, specifies the competent body, the means of publication, and the creation of the corresponding public registry.

Pacts to evade responsibilities

The infringement committed consists of the signing of pacts aimed at avoiding, in fraud of the law, the responsibilities established in article 42.3 of the Legislative Royal Decree 5/2000, of August 4. This conduct is typified and qualified as very serious in article 13.14 of the same regulation.

The original resolution that imposed the sanction was issued on February 12, 2024, by the General Directorate of Labor Relations, and the infringement report was issued on September 26, 2023. The file was processed under reference 2023/0017-0.

Entry in the public registry

The resolution also agrees to the incorporation of the company’s data into the Public Registry of companies sanctioned for the commission of very serious infringements in the field of occupational risk prevention, in accordance with article 2.4 of the Order of the Ministry of Labor of July 30, 2008. The registration data will be cancelled five years from the day following its publication in the DOG, according to article 4.5 of the same order.

The resolution is signed by the General Secretary of Employment and Labor Relations, Susana Pérez Iglesias, in Santiago de Compostela on September 10, 2026.

The publication of the sanction affects a telecommunications company with its own staff and serves as a warning to the sector: very serious infringements in occupational risk prevention are not only punished financially, but are also publicly exposed for five years.
