Clere Ibérica withdraws from the FV Torremendo solar plant in Orihuela

The Territorial Service of Industry, Energy and Mines of Alicante (STIEMA) has declared the withdrawal of the company Clere Ibérica 3, SLU (CIF B05495528) regarding its application for prior administrative and construction authorization for the FV Torremendo photovoltaic plant, with an installed capacity of 1,000 kW and a granted access capacity of 1,000 kW, to be located in the municipality of Orihuela (Alicante). The resolution, dated August 26, 2026, is published in the Official Gazette of the Generalitat Valenciana number 10452, of September 16, 2026, within section III of administrative acts, with reference DOGV-C-2026-28741 and file ATALFE/2024/9/03.

A project halted by the environmental report

The plant, located on plot 31 of polygon 103 of Orihuela, was processed under the integrated authorization procedure for photovoltaic plants on non-urbanizable land of Decree-law 14/2020, of August 7, of the Consell, regarding measures to accelerate the implementation of renewable energies. The application was submitted on March 27, 2024, and was admitted for processing on May 17, 2024, undergoing public consultation for thirty days.

The turning point came with the report from the General Directorate of Natural and Animal Environment, reference FV_300/2025, which was unfavorable. The report maintains the application of the measures of article 28 of Law 11/1994, of December 27, on Protected Natural Areas of the Valencian Community, considering that the installation is within the scope of the Natural Resources Management Plan currently being processed for the future Sierra Escalona and Dehesa de Campoamor Natural Park, and that its execution would entail a significant transformation of the physical and biological reality of the environment.

The reports of the file

During the processing, the following pronouncements were gathered:

• Favorable report from the Rural Improvement Section.
• Unfavorable report from the General Directorate of Natural and Animal Environment.
• Favorable report from the Territorial Risk Management Service.
• Favorable report from the Territorial Planning Service.
• Conditional favorable report from the Landscape Service.

The unfavorable environmental report was further supported by the pronouncements of the Protected Natural Areas Service and the General Advocacy of the Generalitat.

The withdrawal and the archiving

Given the lack of viability of the project under the processed terms, the developer submitted on August 20, 2026 (registry GVRTE/2026/3794576) a written statement of express and total withdrawal of the application that gave rise to file ATALFE/2024/9/03. The company specified that the withdrawal is limited exclusively to this application and procedure, without entailing a waiver of other rights that may correspond to it.

Pursuant to Article 94 of Law 39/2015, of October 1, on the Common Administrative Procedure, the Administration accepts the withdrawal outright and declares the procedure concluded, unless interested third parties request its continuation within ten days. As it is a project with a capacity equal to or less than 10 MW, the processing was carried out via the urgency procedure, with deadlines reduced by half.

Relevance for the territory

The archiving of FV Torremendo evidences the tension between the acceleration of the energy transition driven by Decree-law 14/2020 and the protection of natural spaces currently under processing, such as Sierra Escalona. The resolution confirms that an unfavorable environmental report can be decisive for the viability of photovoltaic projects on non-urbanizable land, and leaves the decision on which energy uses will be compatible in the Vega Baja region of Alicante in the hands of the future management of the natural park.
