Clare County Council petitions High Court to wind up three companies

Clare County Council has petitioned the High Court to wind up three companies, with all three petitions directed to be heard on 2 November 2026. The petitions were presented on 10 August 2026 and are advertised in Iris Oifigiúil No. 85 of 23 October 2026 under record numbers 2026 No. 291 COS, 2026 No. 292 COS and 2026 No. 293 COS. In each notice the council, of Áras Contae an Chláir, New Road, Ennis, County Clare, is named as a creditor of the company concerned.

The three notices are formal advertisements of petition made under Order 74, Rule 10(2), each brought “in the matter of” the Companies Act 2014. They constitute the public notification required before the High Court hears an application to wind up a company in main proceedings, and they name MHP Sellors LLP of 9/10/11 Bindon Street, Ennis, County Clare, as solicitors for the petitioner.

Each notice is dated 23 October 2026 and signed by the Ennis firm. The petitions were presented to the court more than two months earlier, on 10 August 2026, and the hearing date of 2 November 2026 was fixed at that time.

The three companies named

  • Skycourt Management Company Limited — record number 2026 No. 291 COS.
  • UGP Buttevant Limited — record number 2026 No. 292 COS.
  • UGP Shannon SC Limited — record number 2026 No. 293 COS.

The three are the subject of separate petitions brought by the same creditor, and each is described in its own notice as “the company” for the purposes of the application. The notices are published in the statutory notices section of the gazette, alongside other High Court winding-up advertisements and voluntary liquidation notices.

Deadline for intending parties

The notices set out how creditors, contributories and other interested parties may take part in the hearing:

  • Any person who intends to appear must serve written notice of that intention on the petitioner or on MHP Sellors LLP, in person or by post.
  • That notice must reach the Ennis solicitors no later than 5pm on 30 October 2026.
  • The notice must state the name and address of the person, or of the firm, and must be signed by that person or firm or by their solicitor.
  • Any creditor or contributory who wishes to support or oppose the making of an order may appear at the hearing in person or by counsel.
  • A copy of the petition will be furnished to any creditor or contributory who requests it, on payment of the regulated charge.

What the notices record

The advertisements confirm the identity of the petitioner, the council’s address at Áras Contae an Chláir, New Road, Ennis, County Clare, the record number of each petition and the date on which each is to be heard. They do not state the amount of the debt claimed, the nature of the council’s claim against each company, or the value of any assets involved; those particulars would be set out in the petitions themselves, copies of which are available from the petitioner’s solicitors.

The listing brings a local authority’s insolvency action against three companies before the High Court on a single day. With the cut-off for appearances set at 5pm on 30 October 2026, any party with an interest in the Shannon or Buttevant sites has one week from publication to signal an intention to be heard.
