Ciudad Real publica la propuesta de sanción que no pudo notificar

The Provincial Health Delegation of Ciudad Real has published the proposed resolution of sanctioning file IS/13/057/26 after personal notification to the interested party could not be carried out. The announcement, signed by the provincial delegate Francisco José García Sánchez on October 20, 2026, is inserted in the Official Gazette of Castilla-La Mancha (DOCM) no. 210, of November 3, 2026, in section III, Other provisions and acts, with the official reference 2026/7807. The affected party has fifteen business days, counting from the day following the publication, to submit allegations.

The act that remained undelivered

The document specifies that the proposed resolution was issued on August 26, 2026, by the Provincial Delegation of the Ministry of Health in Ciudad Real. In other words, the act had existed since late summer, but it did not reach the recipient through ordinary channels, which forced the use of official publicity as a substitute formula.

The file data identifies the interested party by NIE X9016144Y, with an address for notification purposes in Almendralejo (Badajoz). The publication does not detail the full content of the proposal nor the type of infringement being imputed, details that can only be known through personal appearance at the administrative headquarters.

The law that allows notification via the gazette

The Provincial Delegation supports this formula based on articles 44 and 46 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. These provisions enable the Administration to replace personal notification with an announcement in the official gazette when the former proves unsuccessful, a scenario that the text describes explicitly: “notification attempted and having not been able to be carried out.”

The DOCM thus acts as the sole communication channel, and the announcement itself warns that the publicity is processed through simultaneous insertion in the Official Gazette of Castilla-La Mancha and in the Official State Gazette. This dual channel reinforces the guarantee that the interested party can be aware of the procedure even if they do not reside in the province where the file is being processed, as is the case here.

Fifteen business days and a specific address

The document precisely sets the conditions for exercising the defense:

  • Period for allegations: fifteen business days starting from the day following the publication of this notification.
  • Competent body: Provincial Delegation of the Ministry of Health of Ciudad Real, Legal Advisory unit.
  • Appearance address: Ronda del Carmen, number 1, 8th floor, Ciudad Real.
  • Office hours: from 09:00 to 14:00 hours.
  • Purpose of appearance: full knowledge of the administrative act, i.e., the complete content of the proposed resolution.

A recurring procedure in the province

The notification of November 3 is not an isolated case in the activity of the Provincial Health Delegation of Ciudad Real, which has published several similar announcements in recent weeks. On September 8, 2026, it publicized the proposed resolution of file IS/13/055/26, addressed to an interested party residing in Almargen (Málaga), and one day earlier, on September 7, that of file IS/13/207/25, in this case with a recipient in Casas de Juan Núñez (Albacete). In both instances, the document was signed by the same provincial delegate, Francisco José García Sánchez, and the period granted was likewise fifteen business days.

The pattern is also repeated in resolutions already closed: on October 16, 2026, files TA/13/055/26, IS/13/052/26, and TA/13/007/26 were published, all of them processed by the same provincial delegation. The coincidence of addresses outside of Castilla-La Mancha in several of these announcements points to a recurring difficulty in locating interested parties at their last known address.

Why it matters

For the affected party, this announcement marks the effective start of a peremptory period: outside of those fifteen business days, there will be no other channel to present allegations before the proposed resolution continues its processing. For the general reader, the case illustrates how the regional Administration resolves notification blockages in sanctioning matters and to what extent the official gazette functions as a mandatory legal mailbox when direct contact fails.
