Ciudad Real delegates the awarding of contracts based on framework agreements
Por FactBox Admin

The Local Government Board of the Ciudad Real City Council unanimously approved, in a session on October 5, 2026, to delegate to the Councilor Delegate for Finance the decision-making powers to award contracts based on framework agreements. The agreement is published in the Official Gazette of the Province of Ciudad Real number 194, dated October 8, 2026, with reference AYTOCR2026/39254 and announcement number 3250.
A measure to streamline proceedings
The City Council justifies the decision based on the “high volume of procurement files” that are processed and submitted for the consideration of the Local Government Board, the contracting body. The stated objective is to achieve “greater agility and speed” in processing.
The agreement distinguishes between the two phases that the legal configuration of the framework agreement separates: the award of the framework agreement itself, where the conditions are set, and the award of the based or derived contracts. Since the conditions of the framework agreement are already approved and audited by the Local Government Board, it is considered convenient that the award of the derived contract be carried out by a single-person body, without being submitted again to the collegiate body.
The delegated powers
- The decision-making powers for the award of contracts based on a framework agreement entered into by the City Council, expressly including the award, formalization, modifications, extensions, termination, or any other incident during execution.
- The appointment of Health and Safety coordinators, both in the project drafting phase and in the work execution phase.
- The approval of the Health and Safety Plans for the City Council’s construction contracts, as well as their possible modifications.
- The resolution of appeals for reversal against the acts issued by the delegated body in the exercise of these powers.
Effects, deadlines, and transparency control
- The delegation shall take effect from the day following the date of the agreement, without prejudice to its mandatory publication in the provincial BOP.
- It shall be understood as accepted if, after three days from the adoption or notification of the agreement, the delegate does not express their refusal.
- The agreement revokes any other previously issued with the same purpose.
- Agreements adopted through automated administrative action will be automatically transferred to the various municipal political groups, a measure that is added to the mandatory reporting of decrees and resolutions in the plenary sessions.
The proposal is based on the provisions of articles 123, 124, and 127 of Law 7/1985, of April 2, regulating the Bases of the Local Regime. The document appears signed in Ciudad Real on October 6, 2026, by the Mayor, Francisco Cañizares Jiménez, and by the Secretary General of the Plenary, Joaquín Avilés Morales.
Impact for bidders
The delegation transfers the decision on contracts derived from framework agreements to a single-person body, which reduces one of the processing levels that until now slowed down these files. For bidding companies, the change implies a single point of resolution for award, formalization, modifications, extensions, and termination, in addition to the route of appeal before the delegated body itself. The City Council maintains the transfer of all agreements to the municipal groups as a transparency counterweight.
