Ciudad Real delegates the approval of water fraud settlements to the Urban Planning Department
Por FactBox Admin

The Local Government Board of the Ciudad Real City Council has delegated to the councilwoman in charge of the urban planning area the approval and resolution of financial settlements derived from administrative proceedings regarding water supply fraud, a competence that until now was referred to the collegiate body. The agreement was adopted unanimously in an ordinary session on October 26, 2026, and is published in the Official Gazette of the Province of Ciudad Real number 212, dated November 3, 2026, under announcement number 3533 and secure verification code AaZ/2peTjxno64LHJhSJ.
The origin of this competence lies in the council’s Municipal Water Service Regulations, whose Article 74 expressly attributes to the Local Government Board the approval of financial settlements derived from fraud detected in the municipal network. The administrative proceeding is further supported by Law 7/1985, of April 2, Regulating the Bases of the Local Regime, specifically in its Article 127.1.d) and section 127.2, which enable the delegation of competencies between organs of the same corporation.
The volume of proceedings, reason for the change
The agreement justifies the delegation based on two reasons detailed in its explanatory section: the volume of detected fraud proceedings and the need to process an administrative procedure that is “agile and without undue delays.” According to the text, both factors suggest that these types of settlements should not be referred to the Local Government Board for approval, but should instead be resolved within the corresponding area.
The first point of the agreement delegates to the councilwoman in charge of the urban planning area the approval and resolution of these settlements, in accordance with the Municipal Water Service Regulations. The second point extends the delegation to the power to resolve appeals for reversal filed against the acts issued by the delegated organ in the exercise of those powers. The fourth point revokes any previous agreement issued for the same purpose, such that the new delegation replaces the preceding ones.
Validity, tacit acceptance, and transfer to municipal services
- The delegation shall take effect from the day following the adoption of the agreement.
- It shall be understood as accepted if, after three days from the adoption or notification of the agreement, the delegated councilwoman does not express her refusal.
- Effectiveness is subject to the mandatory publication in the Official Gazette of the Province.
- The sixth point orders the publication of the agreement in the BOP and the transfer of the document to the Fines Service, the Infrastructure Service, and the Collection Service.
The announcement is signed in Ciudad Real, on October 28, 2026, by Cristina Moya Sánchez, head of the Support Organ for the Local Government Board.
Political control of delegated agreements
To ensure that delegation “in no case implies a reduction in municipal transparency,” the fifth point establishes a monitoring mechanism. In all files whose original competence corresponds to the Local Government Board and which are resolved by other municipal bodies through delegation, the electronic administration services will automatically include, via automated administrative action, the various municipal political groups as participants, so that they receive the transfer of all such agreements.
The text is published in section I of the bulletin, dedicated to Local Administration, under the heading City Councils and the header Ciudad Real, and consists of 15 pages within the issue, with the announcement occupying page 7.
Effect on affected users
The measure directly affects users detected defrauding the municipal network: their files will no longer wait for their turn at the Local Government Board and will be resolved in the urban planning area, which also has the capacity to decide on appeals for reversal, thereby shortening the processing time and accelerating the demand for settlements. The reinforcement of political control through automatic information to the municipal groups seeks to compensate for the concentration of decisions in a single unipersonal body.
