Five towns in Albacete jointly tender waste collection
Por FactBox Admin

The Provincial Council of Albacete and the city councils of Alcaraz, Peñascosa, Robledo, Vianos, and Viveros have signed a joint procurement and management entrustment agreement to tender the collection and transport service of urban solid waste in these five municipalities. The estimated value of the contract amounts to 628,394.20 euros, excluding VAT, with an initial duration of one year and up to four further extensions. The agreement is published in the Official Gazette of the Province of Albacete number 116, dated October 5, 2026 (official reference 24.326).
Six administrations sign the agreement
The multilateral agreement was signed on September 18, 2026, by the president of the Provincial Council of Albacete, Santiago Cabañero Masip, and by the mayors of the five municipalities, acting assisted by their respective secretary-auditors:
- Pedro Valero Montoya, mayor of Alcaraz.
- Pedro Rodríguez Córcoles, mayor of Peñascosa.
- Fabio Garbi Diaz, mayor of Robledo.
- Francisco José Torres Navarro, mayor of Vianos.
- Casto Mena García, mayor of Viveros.
The publication of the text, as an annex to the announcement, was arranged on September 21, 2026, by the General Secretary of the corporation, Francisco Suay Ojalvo, in compliance with Article 11 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector. The agreement articulates two distinct legal relationships: the joint procurement between the city councils and the entrustment of management to the Provincial Council as the entity responsible for processing the file.
Distribution of cost among the five city councils
Each council will assume the financing of the contract in proportion to its participation, according to the percentages set in the procurement proposal:
- Alcaraz: 52.91%.
- Robledo: 14.44%.
- Viveros: 11.55%.
- Vianos: 10.70%.
- Peñascosa: 10.40%.
The secretary-auditor offices of each city council have issued certification of the existence of adequate and sufficient credit in the current budget or, where applicable, the commitment to allocate the same amount in the following fiscal year. The city councils are responsible for payments to the contractor only in their proportional part, and the Provincial Council of Albacete shall in no case assume the failure of payment by any of them.
Open procedure and full management by the Provincial Council
The file, with reference 1383047Z, originates from the proposal signed on July 2, 2026, by Luis Ortega Romero, Secretary-Interventor of the City Council of Alcaraz, which proposes the award through an open procedure due to the expiration of the previous contract and the lack of sufficient technical means within the municipalities. The five plenums approved by absolute majority the joint contracting and the entrustment of management to the Provincial Council, which will assume the drafting of the administrative clauses specifications, the publication of the tender notices, the holding of the contracting boards, and the formulation of the award proposal.
The entrustment was accepted by Decree of the President of the Provincial Council No. 4159, dated September 15, 2026, following a favorable report from the Permanent Informative and Monitoring and Control Commission for Public Works on June 8, 2026. The agreement is based on Article 31 of Law 9/2017, of November 8, on Public Sector Contracts, and Article 36 of Law 7/1985, regulating the Bases of Local Regime, and will enter into force the day following its publication in the BOP.
Continuity of service in five small municipalities
This formula prevents each council from separately processing a tender that it cannot handle with its own means and distributes the expenditure based on the weight of each municipality in the service. For the residents of Alcaraz, Peñascosa, Robledo, Vianos, and Viveros, the agreement guarantees the continuity of waste collection after the expiration of the previous contract, while the Provincial Council of Albacete centralizes the processing and the five corporations retain ownership of the competence over the matter.
