Five new permanent health workers in Asturias after court rulings

The Health Service of the Principality of Asturias (SESPA) has published this Thursday, August 13, in Official Gazette of the Principality of Asturias (BOPA) number 156, three resolutions of its Management Directorate, all signed on July 21, appointing five health professionals as permanent statutory staff. The appointments correspond to two nurses, two specialist technicians in radiodiagnosis, and one auxiliary nursing care technician, and are issued within the framework of the temporary employment stabilization process of Law 20/2021, of December 28. Two of the three resolutions expressly enforce judgments of the First Section of the Administrative Litigation Chamber of the High Court of Justice of Asturias (TSJA).

The appointments arise from the merit-based selection processes called by the Resolution of December 15, 2022, of the Management Directorate of SESPA (BOPA of December 27, 2022), under additional provisions six and eight of Law 20/2021. The nursing selection process offered 959 posts (928 from the general free-access shift and 31 from the disability shift); the radiodiagnosis one, 85 posts (80 and 5); and the TCAE one, 993 posts (951 and 42), to which another 50 from the intellectual disability shift were added. The choice of destinations was published on June 26, 2026, on the corporate portal astursalud.es and, once compliance with the requirements was verified, the affected candidates have been declared eligible for appointment.

Enforcement of TSJA judgments

In the Nurse category, resolution with code 2026-06571 is adopted after complying with judgments No. 382 and No. 00379, both of April 21, 2026, of the First Section of the Administrative Litigation Chamber of the TSJA, handed down in ordinary proceedings 826/2025 and 825/2025. In the Specialist Technician in Radiodiagnosis category, resolution with code 2026-06579 enforces judgments No. 238, of March 24, 2026, and No. 00281, of March 10, 2026, corresponding to ordinary proceedings 625/2025 and 505/2025.

The new appointments and their destinations

The five appointed persons will join the Principality’s healthcare network with the following destinations:

  • Nurse (Code 2026-06571): Flor María San Martín Baragaño and María Luisa Martínez de Diego, both to Area VI-Hospital.
  • Specialist Technician in Radiodiagnosis (Code 2026-06579): Silvia María Alonso Álvarez and Aurora Pérez Quesada, both to Area VIII.
  • Auxiliary Nursing Care Technician (Code 2026-06576): Tomasa Gil Martínez, to Health Area IV/Hospital.

Deadlines and conditions

In accordance with the twelfth basis of the call and Decree 50/2019, of 21 June, the successful applicants must take office at the Management of the corresponding Health Area within one month from the day following publication in the BOPA; failure to join attributable to the interested party and without justified cause will entail the lapse of their rights. Those who already hold a permanent post in another category may opt for leave of absence for providing services in the public sector, and taking office will prevent access to other posts derived from stabilization processes under Law 20/2021. The resolutions, which do not exhaust the administrative channel, may be appealed by lodging an administrative appeal before the Ministry of Health within one month.

With these five appointments, the SESPA consolidates posts that remained blocked by litigation and advances in reducing the temporary nature of Asturian health staff, a central objective of the stabilization process of Law 20/2021. The affected persons leave behind their temporary relationship and attain the status of permanent statutory staff, with greater employment and staffing stability for the hospitals and health areas of the Principality.
