Por FactBox Admin

The Mayor-President of the Most Excellent City Council of Écija, Silvia Heredia Martín, has decreed the cessation of Sergio Gómez Ramos from the performance, under a regime of exclusive dedication, of the position of Spokesperson for the Socialist Municipal Political Group. The cessation is effective from September 29, 2026, and is formalized through Decree number 2026-3908, dated September 29, 2026, published in the Official Gazette of the Province of Seville number 192, Friday, October 2, 2026, with official reference BOP-SE-2026-192006. The measure is a direct consequence of the councilor’s resignation from his position as council member.
The origin: resignation of office and notification to the Plenary
The file was activated by the written resignation from his position as Councilor of the Most Excellent City Council of Écija submitted by Sergio Gómez Ramos on September 2, 2026, with Entry Registry notation 2026-E-RPLN-7. The Plenary of the Municipal Corporation became aware of said writing during the Ordinary Session held on September 28, 2026.
The appointment now being revoked originated from Mayoral Resolution number 2023/2257, dated June 19, 2023, issued following the constitution of the Écija City Council on June 17, 2023, for the 2023-2027 term resulting from the Local Elections of May 28, 2023. That resolution determined the members of the Corporation who would perform their functions under a regime of exclusive and partial dedication, including Sergio Gómez Ramos as the socialist spokesperson.
Administrative and remunerative effects
The decree is structured into four sections:
- First: declare the cessation, effective September 29, 2026, of the performance under a regime of exclusive dedication of the position of Spokesperson for the Socialist Municipal Political Group.
- Second: deregister Sergio Gómez Ramos from the General Social Security System, with the same effective date.
- Third: notify the interested party of the resolution for their knowledge and appropriate effects.
- Fourth: publish the resolution in the Official Gazette of the Province, the Notice Board, and the Transparency Portal of the Écija City Council.
The applicable remuneration regime is based on Article 75 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and Article 13 of Royal Decree 2568/1986, of November 28. The reference plenary agreements establish that spokespersons of municipal groups in exclusive dedication receive remuneration equal to that of a General Administration Technician with Service Head responsibility, accrued in fourteen equal payments. For partial dedication, three tiers are contemplated—25, 50, and 75 percent—with minimums of 40 and 80 monthly hours in the first two cases.
Regulatory framework and means of appeal
The resolution also invokes Article 75 bis of Law 7/1985 regarding remuneration limits for members of local corporations, Article 75 ter regarding the limitation of the number of positions with exclusive dedication—which in municipalities of 35,001 to 50,000 inhabitants cannot exceed the established maximum—and Law 53/1984, of December 26, on Incompatibilities of Personnel in the Service of Public Administrations.
Against the resolution, which exhausts administrative remedies, the following may be filed:
- An optional appeal for reversal (recurso de reposición) before the body that issued the act, within one month from the day following the receipt of the notification, pursuant to Articles 123 and 124 of Law 39/2015, of October 1.
- A contentious-administrative appeal before the Contentious-Administrative Court of Seville, within two months, according to Article 46 of Law 29/1998, of July 13.
The resolution is electronically signed by the Mayor-Presidency, Silvia Heredia Martín, with the certification of the Secretary, Rosa María Rosa Gálvez, or the Deputy Secretary, Fátima Gómez Sola, pursuant to Article 3.2 e) of Royal Decree 128/2018, of March 16.
The cessation leaves the socialist spokesperson position vacant in the Écija Plenary and forces the municipal group to reorganize its representation and its dedication regime, in a 2023-2027 mandate in which the composition of the Corporation has already varied due to the resignation of one of its councilors.
