Cidones delegates the Mayor's Office to his first deputy due to the mayor's absence
Por FactBox Admin

The City Council of Cidones has delegated all mayoral functions to the first deputy mayor, José Ignacio Hernando Ruiz, for the period between October 22 and October 26, 2026. This decision was made by the mayor, Pascual de Miguel Gómez, via a Mayoral resolution dated October 21, 2026, published in the Official Gazette of the Province of Soria number 123, corresponding to Monday, October 26, 2026 (reference BOPSO-123-26102026).
A substitution provided for in the local government law
The resolution is based on Article 23.3 of Law 7/1985, of April 2, Regulating the Bases of the Local Regime, and Articles 44 and 47 of the Regulations on the Organization, Operation, and Legal Regime of Local Entities, approved by Royal Decree 2568/1986, of November 28. The regulation assigns deputy mayors, in their capacity as such, the substitution of the mayor in all their functions, following the order of their appointment, in cases of absence, illness, or impediment.
The published text justifies the measure on the grounds that the mayor will be absent from the municipality during that period due to the death of a relative. The delegation therefore extends to the five calendar days from Thursday, October 22, to Monday, October 26, 2026, both inclusive.
Management and resolution powers regarding third parties
The operative agreement specifies the scope of the delegation in two areas:
- Management and ordinary administration powers of the City Council.
- The capacity to resolve appropriate administrative procedures through the adoption of administrative acts affecting third parties.
The delegated body is obliged to inform the Mayor’s office, a posteriori and whenever requested, of the management carried out and the provisions issued during the reference period. This must be done in advance in the case of decisions classified as significant, in accordance with Article 115 of the aforementioned state regulation.
Tacit acceptance and political control
The effectiveness of the delegation is conditional upon the acceptance of the delegated body. This is understood to be granted tacitly if no express manifestation of non-acceptance is filed with the Mayor’s office within three business days starting from the day following the notification of the resolution.
The resolution also orders its publication in the Official Gazette of the Province and that its content be reported to the Plenary of the Corporation at the first session it holds. For matters not expressly provided for, the provisions of Law 7/1985 and Royal Decree 2568/1986 regarding delegation shall apply directly.
Appeal process
The decree exhausts all administrative remedies, in accordance with Article 52 of Law 7/1985 and Article 123 of Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations. The following appeals may be filed against it:
- An optional appeal for reversal (recurso potestativo de reposición) before the Mayor’s Office of Cidones, within one month from the day following the receipt of the notification.
- A contentious-administrative appeal before the Contentious-Administrative Section of the Court of First Instance of Soria, within two months from that same date.
The announcement is submitted for publication pursuant to Article 44.2 of the local government regulations, and the document is dated in Cidones on October 21, 2026.
The publication allows the residents of Cidones to know who is materially exercising the Mayoralty during those five days and to whom procedures affecting third parties must be addressed, in addition to establishing the framework for subsequent control of the decisions adopted during that interval.
