The Third Vice-Presidency and Department of Environment, Infrastructure, Territory and Recovery has opened the public information period and has summoned the owners of the affected assets and rights to the drawing up of the records prior to the occupation of the compulsory expropriation file initiated for the Dana-2024 emergency works for the rehabilitation of the bridges on the CV-50 road at PK 74+000 and 76+200, in the municipality of Cheste. This is established by the Resolution of September 7, 2026, published in the Official Gazette of the Generalitat Valenciana (DOGV) number 10449, of September 11, 2026, with reference DOGV-C-2026-28824, corresponding to File 2025-11.

Regulatory Framework and Background

The works are located in a municipality included in the annex of Royal Decree-Law 6/2024, of November 5, which adopts urgent response measures for the damage caused by the isolated depression at high levels (dana) in various municipalities between October 28 and November 4, 2024. They are subject to Decree-Law 11/2024, of November 12, of the Consell, which declares as public utility or social interest, as well as the urgent occupation of the affected assets, rights, and lands for compulsory expropriation, temporary occupation, or imposition of easements, as a result of the execution of contracts processed through the emergency procedure for the reconstruction or restitution of road and rail infrastructures affected by the dana.

The procedure is processed in accordance with Article 52 of the Compulsory Expropriation Law, of December 16, 1954, and the concordant provisions of the Regulation of April 26, 1957. The resolution is signed by Juan Martínez Caballero, Undersecretary of the Third Vice-Presidency and Department, exercising delegated signature authority.

Public Information and Prior Records

The list of affected assets and rights is submitted for public information for a period of 15 business days, starting from the day following the publication of the announcement in the DOGV, so that the holders and other interested parties may submit written allegations to the department, in accordance with Articles 17 and 18 of the Compulsory Expropriation Law and Article 56 of its regulation.

The expropriation annex can be consulted at the headquarters of the Expropriations and Asset Management Service, in the Ciudad Administrativa 9 de Octubre, calle de la Democracia, 77, Valencia, as well as on the department’s website. The drawing up of the records prior to occupation will take place at the location provided by the City Council:

  • Cheste City Council, October 14, 2026, from 09:00 to 12:30
  • Cheste City Council, October 15, 2026, from 09:00 to 12:30

This publication shall serve as notification for interested parties who are unknown or whose address is ignored, although interested parties will be individually summoned to the act of drawing up the records.

Affected assets and owners

The annex contains the list of affected properties in the municipality of Cheste, with their cadastral references and areas, which include expropriation, easement, and temporary occupation. Among the owners are:

  • Cheste City Council
  • Ministry for the Ecological Transition and the Demographic Challenge
  • Cheste-Chiva Water Irrigators Community
  • Private individuals such as Vicente Cortes Segarra, Antonio Soriano Ruiz, Julio Antonio García Esteve, Evelio Morte Herraiz, Ernesto Montesa Verduch, Eduardo Zanon García, Jose Vicente Viñambres Soriano, and María Pilar Sánchez Fortea, among others

The affected properties correspond to rural uses such as irrigated farmland, olive groves, wasteland, scrubland, ravines, irrigation ditches, public domain roads, and gardens.

Relevance of the action

The expropriation is essential to carry out the rehabilitation of the two bridges on the CV-50 damaged by the DANA of October 2024, a key route for the region’s mobility. The emergency procedure allows for the acceleration of the reconstruction of road infrastructure, and the summons for the preliminary records marks the beginning of the occupation of the land, a decisive step so that affected owners can exercise their rights and for the works to progress within the planned deadlines.
